| 520 | |a يعتبر انتشار الأوبئة الصحية ذو أثر كبير على الصحة العامة وخاصة في الآونة الأخيرة أبان الأمراض والأوبئة المنتشرة في البلاد أمثال الحمى النزفية وفيروس كورونا وغيرها فكان لابد من إعلان حالة الطوارئ الصحية ويكون ذلك وفقا لشروط عامة وأخرى خاصة والتي تتمثل بانتشار عدوى المستشفيات العامة من جهة، وما صاحب ذلك من ضعف في قانون الصحة العامة العراقي رقم ۸۹ لسنة ۱۹۸۱ النافذ وعدم وجود قانون للطوارئ الصحية في البلاد يعالج الأزمات والأوبئة المنتشرة في العراق من جهة أخرى. وفي نهاية بحثنا توصلنا لجملة من النتائج والتوصيات وكان من أهم النتائج أن حالة الطوارئ الصحية تعد حالة استثنائية تعصف بالبلاد من أوبئة وأزمات صحية فتؤدي بالسلطة التنفيذية بالخروج عن مبدأ المشروعية في بعض الأحيان لمواجهة تلك الظروف الاستثنائية لكن عليها أن تراعي مبدأ التناسب في كل ذلك مع الإشارة إلى انه لا يوجد في العراق قانون للطوارئ الصحية يعالج تلك الظروف، إما عن التوصيات كان من أهمها على المشرع العراقي تحديد موجبات إعلان حالة الطوارئ الصحية في أمر الدفاع عن السلامة الوطنية رقم 1 لسنة ٢٠٠٤ أسوة بقانون السلامة الوطنية رقم (٤) لسنة ١٩٦٥ الذي حدد أسباب إعلان حالة الطوارئ عند تعرض البلاد لظروف استثنائية فكيف لأمر الدفاع عن السلامة الوطنية (1) لسنة ٢٠٠٤ أن يتغافل عن ذلك. |b The spread of health epidemics has a significant impact on public health, especially in recent times during diseases and epidemics spread in the country, such as hemorrhagic fever, Corona virus, and others. It was necessary to declare a state of health emergency, according to general and other special conditions, which are represented in the spread of infection in public hospitals on the one hand, and what This was accompanied by weakness in the Iraqi Public Health Law No. 89 of 1981 in force, and the absence of a health emergency law in the country that addresses crises and epidemics spreading in Iraq on the other hand At the end of our research, we reached a number of results and recommendations, and one of the most important results was that the state of health emergency is an exceptional situation that ravages the country from epidemics and health crises, leading the executive authority to deviate from the principle of legality sometimes to face those exceptional circumstances, but it must observe the principle of proportionality in all of this with reference He pointed out that there is no health emergency law in Iraq that addresses these conditions. As for the recommendations, the most important of which was that the Iraqi legislator should specify the requirements for declaring a state of health emergency in the Defense of National Safety Order No. 1 of 2004, similar to the National Safety Law No. (4) Of 1965. Determine the reasons for declaring a state of emergency when the country is exposed to exceptional circumstances, so how can the Defense of National Safety Order (1) of 2004 ignore that? | ||
