| المستخلص: | إن الشريعة الإسلامية قد وضعت نظاما متكاملا وشاملا للميراث، وقد تولاه الله تعالى دون تركه لإرادة الإنسان، فجاءت آيات الميراث وأحاديث الرسول صلى الله عليه وسلم ونظمت أحكامه من جميع النواحي، فالميراث هو "خلافة إجبارية للوارث في مال مورثه أو في حق قابل للخلافة"، ولكن يحدث كثيرا في واقعنا المجتمعي بأن يتم حرمان أحد الورثة أو أكثر من ميراثه الذي هو حقه الثابت من قبل الله تعالى، ومن صور هذا الحرمان هي تقسيم المورث لأمواله حال حياته، وفيها قد يحرم بعض الأولاد من الميراث فيعطي البعض دون الآخر، والصورة الأخرى هي الحرمان من الميراث للأبن العاق، وفيها أن هذا الأبن يخرج عن طاعة أبيه مما يدفع الأب إلى حرمانه من الميراث، والصورة الأخرى هي حرمان البنت من الميراث، وفيها يفضل الأبن على البنت فيعطى للأبن دون البنت. The other form is the deprivation of inheritance to the disobedient son, in which this son disobeys his father, which leads to The father is deprived of inheritance, and the other form is depriving the daughter of inheritance, in which the son is preferred over the daughter and is given to the son rather than the daughter. |
