| المستخلص: | يشكل التنظيم القانوني لحماية حرية التعبير عن الرأي موضوعا مهما للدراسات في القانون الدستوري، فعلى الرغم من وجود قوانين وتشريعات دولية وإقليمية، ووطنية لتنظيم حرية الرأي والتعبير، إلا أنها تشهد كثيرا من الانتهاكات والقيود التي تعرقلها وتمنع المواطن من حقه في التعبير عن رأيه. ومن اجل التصدي لهذه الانتهاكات ووضع القواعد والضوابط التي تكفل صون هذه الحرية وحمايتها في إطارها المشروع دون أن تتجاوزه إلى الإضرار بالغير أو بالمجتمع فأننا اخترنا موضوعنا هذا لمناقشة حالة العراق بهذا الخصوص. ولغرض دراسة هذا الموضوع، جرى تقسيمه على مبحثين؛ يتناول المبحث الأول تعريف "حرية التعبير عن الرأي" ونطاق حمايتها على المستوى الإقليمي والدولي، أما الثاني فخصصناه لمناقشة موضوع حرية الرأي ضمن التشريعات العراقية. The legal regulation for the protection of freedom of expression is a major subject of studies in international human rights law. Despite the existence of international, regional, and national laws and legislations regulating freedom of opinion and expression, they witness many violations and restrictions that impede them and prevent citizens from their right to express their opinion. In order to address these violations and establish rules and controls that guarantee the preservation and protection of this freedom within its legitimate framework without exceeding it to harm others or society, we have chosen this topic to discuss the case of Iraq in this regard, since the establishment of the Iraqi state until today, For the purpose of studying this topic, it was divided into two sections. The first section deals with the definition of "freedom of expression" and the scope of its protection at the regional and international levels. As for the second, we devoted it to discussing the issue of freedom of opinion within Iraqi legislation. |
