| المستخلص: | يتناول هذا البحث: "القواعد الفقهية في الإقرار -دراسة فقهية نظامية -"، جمع وعرض أبرز القواعد الفقهية المتعلقة بالإقرار ودراستها دراسة فقهية جامعة، تناولت صورة القاعدة وحكمها الشرعي وموقف النظام السعودي منها، مع ذكر ما يتعلق بها من الأدلة والشروط ومواطن الاتفاق والاختلاف بين العلماء والتطبيقات لكل قاعدة. ومهدت له بتعريف القواعد الفقهية في اللغة والاصطلاح الفقهي، وتعريف الإقرار في اللغة والاصطلاح الفقهي والنظامي، مع ذكر أركان الإقرار في الفقه والقانون، وحجيته الشرعية. اعتمدت في البحث على الاستقراء والرجوع إلى أقوال الفقهاء في المذاهب الأربعة، وتوثيقها، والاستشهاد بها. مع ذكر نظام الإثبات السعودي الصادر بالمرسوم الملكي رقم م/ ٤٣ وتاريخ ٢٦ / ٥ / ١٤٤٣ هـ، ونظام المرافعات الشرعية السعودي الصادر بالمرسوم الملكي رقم م / ١ وتاريخ ٢٢ / ١ / ١٤٣٥ هـ. وقد انتهت الدراسة بجمع خمس عشرة قاعدة متعلقة بموضوع الإقرار. وأوصت الدراسة الباحثين على تنزيل المواضيع القانونية على القواعد الفقهية ودراستها دراسة تطبيقية. This research deals with: "The jurisprudential rules of confession - a systematic jurisprudential study -", by collecting and presenting the most prominent jurisprudential rules related to confession and studying them in a comprehensive jurisprudential study to clarify the image of the rule, its legal ruling, and the Saudi regime’s position on its ruling, along with mentioning of the evidence, conditions, points of agreement and disagreement between scholars as well as the applications of each rule. I paved the way for it by defining jurisprudential rules in the linguistic and jurisprudential terminology, and defining confession in the linguistic, jurisprudential and legal terminology, with mentioning the pillars of confession in jurisprudence and law, and its legalistic substantiation. In the research, I relied on extrapolation and reference to the opinions of the jurists in the four schools of thought, documenting them, and citing them, in addition to mentioning the Saudi Evidence System issued by Royal Decree No. M / 43 dated 5/26/1443 AH, and the Saudi Legal Procedure System issued by Royal Decree No. M / 1 dated 1/22/1435 AH. The study concluded with the collection of fifteen rules related to the subject of confession. The study recommended that researchers search for relating legal topics to jurisprudential rules and studying them as an applied study. |
