| المستخلص: | بذل الفقيه النوازلي أبو القاسم بن عظوم القيرواني (1009هـ) جهودا كبيرة في النقد الفقهي، ولما كان إبراز جهود هذا العلم في النقد لا يخلو من أهمية كبيرة في إثراء المذهب وخدمته، وتنمية الملكة الفقهية لدى الباحثين، عالجت هذا الموضوع منطلقا من إشكال رئيس يتمثل في التساؤل الآتي: كيف تكونت عقلية ابن عظوم النقدية في عصر ساد فيه التقليد؟ وأين تتجلى جهوده النقدية في فتاويه؟ وقد اعتمدت في الإجابة على هذا الإشكال المنهج الاستقرائي التحليلي، وذلك باستقراء تجليات النقد الفقهي لدى ابن عظوم في كتابه الأجوبة، ومناقشتها بهدف إبراز مجالاته واستخلاص أسسه وروافده المثمرة له، وبعد الدراسة توصلت إلى مجموعة من النتائج، منها: تميز منهج ابن عظوم في النقد الفقهي بالموضوعية وقوة المناظرة والجدل، والحدة والجرأة في الرد، نتيجة عوامل ذاتية، وموضوعية، وأخرى سياسية وقضائية، وقد اعتمد في ذلك أسسا وأدوات، مستمدة من جنس مادة موضوع النقد. The scholar of contemporary issues, Abou Al Qassim Ibn Athoum El Qayrawani (1009 A. H), made great efforts in the field of juristic critcism. No doubt, this branch of knowledge is of paramount importance as it enriches the doctrine and promotes the juristic aptitudes of researchers. The questions which arise here are: How was the critical mind of Ibn Athoum formed in an era when imitation was prevalent? And how was critical thinking reflected in his legal opinions ? To answer these questions, I used the inductive and analytical method by deriving the manifestation of Ibn Athoum’s jurisprudential criticism from his book: ‘Answers’. Also, throughout my study of the subject, I aimed at highlighting his emergence as an imminent scholar, and deriving the basis as well as the fruitful branches of his thoughts. Thus, among the interesting results I have come to is the disntinction of Ibn Athoum’s method in juristic criticism. He clearly employed a high degree of objectivity, the art of debate and discussion, acuteness, along with his courageous responses. Besides, he made use of principles and tools that he attained from the essence of the subject under criticism. In brief, Ibn Athoum was actually influenced by subjective, objective, political and judicial factors. |
