| المستخلص: | لقد ظهرت الجريمة باعتبارها ظاهرة اجتماعية مع نشأة الحياة الاجتماعية على سطح الأرض، وقد احتلت مكان الصدارة في الدراسات العلمية، الأمر الذي أدى إلى كشف الستار على بعض جوانبها وإخراجها إلى دائرة الفهم والتحليل. نجد أن معاناة الضحية ولفترة طويلة من التهميش والإهمال في الدراسات الجنائية أدى إلى بقاء ضحايا الجريمة لمدة طويلة من الزمن منسيين، نظرا لتسليط الضوء على حقوق المتهم من قبل المدارس الفقهية العديدة التي ركزت جل اهتمامها عليه إلا أنه بدأت مع مطلع الأربعينيات من القرن العشرين ظهور العديد من المحاولات التي تولي أهمية لدراسة العلاقة بين الجاني والضحية حتى يتحقق مزيد من الفهم لمنشأ السلوك الإجرامي. وفي هذا السياق تحاول الدراسة الراهنة الاقتراب من موضوع الضحية، وقد تمت معالجة هذا الموضوع من خلال بحث مجموعة من الإجراءات القانونية لحماية ضحايا الجريمة على المستوى الداخلي والدولي. ولم يقتصر هذا العلم على دراسة الضحية وعلاقته بالجاني، بل امتد ليشمل دراسة حقوق الضحية سواء على المستوى الإجرائي أو الموضوعي. إن مدخل أسلوب الحياة والنشاط الروتيني والذي يوضح أن أسلوب الحياة الذي يسير عليه الشخص يرتبط ارتباطا وثيقا بوقوعه ضحية للجريمة من خلال تعريض نفسه للمواقف التي تؤدي إلى هذه العملية أيضا قدمت الدراسة الراهنة العديد من المحاولات الخاصة بتصنيف ضحايا الجريمة والحماية القانونية والاجتماعية. ولقد انتهت الدراسة إلى جملة من النتائج أن حماية حقوق ضحايا الجريمة تستوجب الاستجابة الفورية من قبل أجهزة العدالة للبلاغ الذي يتقدم به الضحية واتخاذ الإجراءات القانونية بشأنه، وتحقيق الحماية لضحايا الجريمة وأسرهم وإزالة الضرر الذي لحق بهم فورا، وكفالة حق الضحايا في الوقوف على سير الإجراءات الجنائية والاستماع لرأيهم في الإجراءات. واحترام موقف المتضرر من الجريمة وتقدير حالته النفسية والعمل على رفع معنوياته، ومساعدة المجني عليه وأفراد أسرته للخروج من الأزمة النفسية أو الضائقة المالية، وحفظ الأسرار الشخصية للمتضرر من الجريمة وأسرته، والعمل على تعويض المتضرر من الجريمة وفقا للقانون. Crime has emerged as a social phenomenon with the emergence of social life on the surface of the earth, and has taken the lead in scientific studies, which led to the unveiling of some aspects of it and brought it to the circle of understanding and analysis. We find that the victim suffered for a long period of marginalization and neglect in criminal studies. Many attempts to attach importance to the study of the relationship between the perpetrator and the victim in order to achieve a better understanding of the origin of criminal behavior. In this context, the present study attempts to approach the subject of the victim. Domestic and international level This science was not limited to the study of the victim and its relationship to the perpetrator, but also extended to the study of the rights of the victim, both at the procedural and substantive level. The approach to lifestyle and routine activity, which shows that the way of life is closely related to being a victim of crime by exposing himself to situations that lead to this process, also the present study has presented many attempts to classify the victims of crime and legal and social protection. Concerning the protection of the rights of victims of crime, the justice agencies must respond promptly to the victim's communication and take legal action. To ensure the protection of victims of crime and their families and to remove the damage inflicted upon them immediately, and to ensure the right of victims to stand on the conduct of criminal proceedings and to hear their opinion in the proceedings, and to respect the position of the victim of the crime and to assess his psychological condition and work to raise morale, and to help the victim and his family to get out of the psychological crisis or distress Financial, preserve the personal secrets of the victim of the crime and his family, and work to compensate the victim of the crime in accordance with the law. |
