| المستخلص: | عرف مجتمع المغرب الإسلامي في شقيه الأدنى والأوسط ظواهر اجتماعية لم تسلم من مختلف الآفات والمناكر اللا أخلاقية وخاصة على مستوى الطرقات والأسواق كانتشار معاملات الربا والغش والتطفيف أو على مستوى المساجد من آفة سؤال الضعفاء فيه برفع الصوت، أو مثل ما تفعله النساء من المناكر والسلوكات المشينة، وغيرها من الفواحش والرذائل، وهو ما شكل خطرا على تركيبة المجتمع وعلى قيمه ومبادئه الإسلامية، وفي إطار هذا وحتى نبين أسباب هذه الظواهر ونكشف أسبابها وطرق معالجتها، تضمنت هذه الورقة البحثية دراسة تحليلية مقارنة بين مصدر الحسبة للعقباني في كتابه: "تحفة الناظر وغنية الذاكر في حفظ الشعائر وتغيير المناكر"، وكتاب البرزلي الموسوم بـ" فتاوى البرزلي جامع مسائل الأحكام لما نزل من القضايا بالمفتين والحكام". وقد جاء هذا الاختيار لرؤية الدور الذي قام به كل من الإمام البرزلي والإمام العقباني في مكافحة الآفات الاجتماعية، وأيضا لفهم الطرق والقواعد التي ينطلق كلاهما منها، بهدف توفير الغطاء الديني والشرعي الذي يحده من انتشار الآفات الاجتماعية والأخلاق والسلوكات الذميمة. Both Lower and Middle parts of the Islamic Maghreb community have known social phenomena full of lesions and unethical abominations, especially on the level of roads and markets, such as the spread of usury transactions, cheating and fraud, or on the mosques level where beggars ask for charity loudly/violently/impolitely, or like what women do as abominations, disgraceful behaviors and others as well as vices that presented a danger on the composition of the community and its Islamic values and principles. And in this context, and in order to show these phenomena and reveal their causes and the ways to solve them, this research paper has included an analytic comparative study between the "Hisba" source of Al Akabani in his book "Tuhfatou Nadhir wa Ghunyet Thakeer fi Hifd Shaair wa Taghyeer al Manakeer" and Al Barzali book tagged/entitled "Fatawa Al Barzali Jamie Massail al Ahkam lima Nazal mina Lkadaya bilmouftiyin wa Lhoukam.". This choice came to show the role of both Imams/forwards Al Barzali and Al Akabani in fighting social lesions and also in order to understand the methods and the rules that each of them proceeds from so as to provide both religious and legitimate covers that reduce the spread of social lesions and reprehensible behaviors. |
