| المستخلص: | جاء هذا البحث بعنوان: واقع وضوابط الاستثمار في الصناديق الاستثمارية في البنوك الإسلامية في العراق، وتلخصت المشكلة بالسؤال الرئيسي التالي ما هو واقع وضوابط الاستثمار في الصناديق الاستثمارية في البنوك الإسلامية في العراق؟ وتبرز أهمية الموضوع من خلال عدم إفراد هذا الموضوع ببحث مستقل على هذا النحو بحسب علم الباحثة، وحاجة المجتمعات الإسلامية لدراسة هذه المواضيع الطارئة عليها ومعرفة موقف الشريعة الإسلامية منها، وكثرة تعدد أنواع الصناديق الاستثمارية في المصارف خاصة الإسلامية منها، وأن هذا الموضوع يتعلق بالمال الذي هو عصب الحياة، وبيت القصيد لدى الناس، ويهدف البحث إلى بيان الحكم الشرعي لهذه النوازل الطارئة في المعاملات المالية المعاصرة، وجمع شتات هذا الموضوع من مظانه، وأخذ صورة متكاملة عنه، مع معرفة ما استجد فيه من معاملات، وتصحيح مسار الغارقين في المعاملات الربوية، وذلك من خلال بيان البدائل المتاحة شرعا للاستثمارات المالية، وإعطاء صورة واضحة لمن يريد معرفة الحق في المعاملات الاستثمارية بالصناديق، ودفع تشكيك المتربصين بالمصارف الإسلامية حول هذه الاستثمارات؛ لإثبات صلاحية المصارف الإسلامية، وقدرتها على الثبات في أرض الواقع، وذلك لتطبيقها الأسس الشرعية في المعاملات المصرفية، ودعم المصارف الإسلامية العاملة بالعقود الشرعية، المطبقة للضوابط الشرعية في معاملاتها، وذلك بإعطاء الإطار النظري لتجارتها في الصناديق الاستثمارية، وقد استخدمت الباحثة المنهج الاستقرائي والتحليلي. This study came under the title of the reality and controls of investment in investment funds in Islamic banks in Iraq, and the problem was summarized by the following main question: What is the reality and controls of investment in investment funds in Islamic banks in Iraq? The importance of the topic is highlighted by not singling out this topic for independent research in this way according to the researcher’s knowledge, and the need of Islamic societies to study these urgent topics and know the position of Islamic Sharia regarding them, and the large number of types of investment funds in banks, especially Islamic ones, and that this topic is related to money. Which is the nerve of life, and the bottom line for people, and the research aims to clarify the legal ruling for these emergency calamities in contemporary financial transactions, and to collect the scattered pieces of this topic from its perspective, and to take an integrated picture of it, with knowledge of the new transactions in it, and correcting the path of those drowning in usurious transactions This is done by explaining the legally available alternatives for financial investments, giving a clear picture to those who want to know the right to invest in funds, and prompting the suspicion of those intruders in Islamic banks about these investments; To prove the validity of Islamic banks, and their ability to be stable in reality, for their application of the legal foundations in banking transactions, and to support Islamic banks operating with Sharia contracts, applied to Sharia controls in their transactions, by giving the theoretical framework for their trade in investment funds, the researcher used the inductive and analytical approach. |
