| المستخلص: | الباحث في مذاهب الفقهاء يجد اختلافا كبيرا بين أهل العلم في الحكم الشرعي بين مذهب وآخر، بل إن الاختلاف في الأحكام موجودة في المذهب الواحد، ويرجع سبب الاختلاف إلى عدة عوامل، فأردت أن أبحث في سبب واحد من هذه الأسباب هو الاختلاف في تفسير المشترك، وما ينتج عنه من اختلاف، فعرفت المشترك، وذكرت أقسامه، وبينت اختلاف الفقهاء في تفسيره، وما يترتب على ذلك من اختلاف في الحكم الشرعي، وذكرت بعض التطبيقات من اختلاف الفقهاء الأحكام الشرعية بسبب المشترك. The researcher in the doctrines of jurists finds a great difference between the scholars in the legitimate rule between one doctrine and another ,but the difference in the provisions exists in the same doctrine ,and the reason for the difference is due to several factors, I wanted to look at one of these reasons is the difference in the interpretation of the common verbal ,and the resulting difference, so I knew the common verbal ,mentioned its sections ,and showed the difference of jurists in its interpretation ,and the consequent difference in the legitimate judgment ,and I mentioned some applications of different jurisprudence rulings legitimacy because of the common verbal. |
