| المستخلص: | هذا البحث بعنوان رأي الإسلام في ضمان خطأ القابلات الطبية دراسة في ضوء نوازل الشريعة والقانون اليمني، حيث استخدمت فيه المنهج الاستقرائي القائم على الاستدلال والاستنباط والتحليل العلمي، وقد تكون من مقدمة وأربعة مباحث وخاتمة، وقائمة بأهم المصادر والمراجع. أما المبحث الأول: فقد تحدثت فيه عن مفهوم خطأ القابلات الطبية، فتناولت في المطلب الأول: التعريفات والمصطلحات، كما بينت في المطلب الثاني: معنى القابلة ومهامها الأساسية، وأما في المطلب الثالث: فأوضحت حكم مهنة القبالة في الشريعة الإسلامية والقانون اليمني، وأما المبحث الثاني: فقد بيت فيه أسباب أخطاء القابلة الطبية تجاه المرضى. حيث أوردت كلام أهل العلم مستشهداً بالأدلة والبراهين، ومفرقا بين الأخطاء الفنية والأخلاقية، حيث ذكرت في المطلب الأول: الجهل وعدم التأهيل العلمي، وتناولت في المطلب الثاني: التقصير في إتباع الأصول العلمية والعملية، وقصد الاعتداء. وأما المبحث الثالث: فقد تناولت فيه بيان تضمين خطأ القابلات الطبية في نظر الفقه الإسلامي، حيث استقرأت وحللت مذاهب الفقهاء في ذلك واستدلالاتهم والراجح منها، فتناولت في المطلب الأول: مفهوم التضمين وأسبابه عند الفقهاء، وبينت في المطلب الثاني: أحوال تضمين الطبيب عند الفقهاء، وكما أصلت المسألة في المطلب الثالث: وذلك بذكر أقوال الفقهاء في تضمين خطأ الطبيب وعقوبته. وأما المبحث الرابع: فقد تناولت فيه موقف القانون اليمني من ضمان خطأ القابلات الطبية، فذكرت في المطلب الأول: مفهوم المسؤولية، وشروطها في القانون اليمني. وأوضحت في المطلب الثاني: أقسام الجرائم في القانون اليمني. حيث وقفت على آخر تعديلاته، وأرقام مواد. ثم أختتم البحث بأهم النتائج والتوصيات، وقائمة أهم المصادر والمراجع، لتكتمل بذلك الصورة العامة لموضوع البحث. The research is titled "Islamic Perspective on Guaranteeing the Malpractice of Midwives: A Study in Light of Principles of Islamic Law and Yemeni Law." It employs the inductive method based on inference, deduction, and scientific analysis. The research consists of an introduction, four sections, a conclusion, and a list of important references. In the first section, the concept of the malpractice by midwives is discussed. It covers the definitions and terminology, the meaning of a midwife, and their primary duties. It also clarifies the status of midwifery in Islamic Sharia and Yemeni law. The second section explores the reasons behind medical errors committed by midwives towards patients. It presents the views of scholars supported by evidence, distinguishing between technical and ethical errors. It addresses issues such as ignorance and lack of scientific qualification, failure to follow scientific and practical principles, and intentional harm. The third section examines the inclusion of medical malpractice by midwives according to Islamic jurisprudence. It investigates the opinions of scholars and their justifications, focusing on the most prevalent views. According to jurists, it discusses the concept of inclusion and its reasons, explains the conditions for the inclusion of a physician, and lastly substantiates the matter by citing the opinions of jurists regarding the inclusion of medical errors by physicians and their punishments. The fourth section analyzes the stance of Yemeni law regarding the guarantee of malpractice of the midwives. It explains the concept of responsibility and its conditions in Yemeni law. It also examines the different categories of crimes in Yemeni law, including the latest amendments and relevant article numbers. The research concludes with the presentation of key findings and recommendations, along with a list of important sources and references, providing a comprehensive overview of the research topic. |
