| المستخلص: | تهدف هذه الدراسة إلى الوقوف على مقومات العدالة المبثوثة في ثنايا النظام القضائي الإسلامي التي تكفل لطرفي المحاكمة المدعي والمدعي عليه ابتداء من لبنة الجهاز القضائي وهو القاضي وما يتطلب فيه من متطلبات، مرورا بالمبادئ التي يتعامل بها النظام القضائي مع طرفي المحاكمة، واقتضت طبيعة الدراسة اتباع المنهج الوصفي التحليلي لتوصيف الجوانب الإجرائية في النظام القضائي الإسلامي، وتحليلها لإظهار مقومات العدالة التي تبث في نفوس المتعاملين مع هذا النظام الطمأنينة والإذعان، وخلصت الدراسة إلى أن النظام القضائي الإسلامي قد بلغ حد الإشباع في تحري العدالة يمكن ملاحظتها في كل تفاصيله الموضوعية والشكلية، وأن هذا النظام يحقق الحد الأعلى من مقومات العدالة لأطرافه. This study aims to identify the elements of justice broadcast in the folds of the Islamic judicial system that guarantee the parties to the trial the plaintiff and the defendant, starting from the building block of the judicial system, which is the judge and the requirements required in it, through the principles by which the judicial system deals with the parties to the trial, and the nature of the study required the adoption of the descriptive analytical approach to describe the procedural aspects in the Islamic judicial system. The study concluded that the Islamic judicial system has reached the point of saturation in the investigation of justice, which can be observed in all its objective and formal details, and that this system achieves the highest level of the elements of justice for its parties. |
