| المستخلص: | أولى المشرع المغربي من خلال مدونة الأسرة اهتماما كبيرا للصلح في قضايا الطلاق والتطليق إذ جعل الصلح إجراءا مسطريا جوهريا، إلا أن الواقع العملي والإحصائيات الصادرة عن مختلف أقسام قضاء الأسرة بمحاكم المملكة تؤكد أن نسب نجاح عملية الصلح في قضايا الطلاق والتطليق تبقى ضعيفة ولا ترقى إلى طموحات مختلف الفاعلين والمتدخلين في قضايا الأسرة، ليبقى الأشكال المطروح هو الأسباب التي تعيق تفعيل مؤسسة الصلح وتحقيق المقصد النبيل منه وهو الحفاظ على استقرار الأسرة المغربية، وهذا ما سأحاول تسليط الضوء عليه وذلك من خلال استحضار النصوص التشريعية المؤطرة ومعيقات تفعيل مسطرة الصلح والاقتراحات الممكنة لتجاوز هذه المعيقات وجعل مؤسسة الصلح تلعب الدور المنوط بها وتحقق غايتها النبيلة. The Moroccan legislator has given great importance to reconciliation in divorce and separation issues, making it a fundamental and essential procedure. However, the reality and statistics issued by various departments of the family courts in the kingdom confirm that the success rate of reconciliation in divorce and separation cases remains weak and does not meet the aspirations of various stakeholders and interveners in family issues, and the problems raised are the reasons that hinder the activation of the reconciliation institution and achieving its noble goal of preserving the stability of the Moroccan family. This is what I will try to shed light on through my intervention, through the presentation of regulatory texts and obstacles to the activation of the reconciliation process and possible suggestions to overcome these obstacles and make the reconciliation institution play its role and achieve its noble goal. |
