| المستخلص: | تهدف هذه الدراسة إلى بيان ماهية الاتجار الإلكتروني بالبشر، والوسائل المتبعة من قبل المجرمين لتنفيذ جرائمهم المتنوعة، عبر استغلال شبكة الاتصالات العالمية (الإنترنت) وتقنياتها المختلفة من أجل الاحتيال على فئات من البشر للمتاجرة بأعراضهم، أو أعضائهم الجسدية، أو استغلال طاقاتهم، بهدف الحصول على المرابح المالية من خلال استغلال جسد الإنسان المجني عليه أو أعضائه، وتحويله إلى سلعة تباع وتشترى، وبينت صور الاتجار الإلكتروني بالبشر وأنواعه، والتي تشمل الاستغلال الجنسي للنساء والأطفال، واستغلال بعض الفئات من الناس في السخرة والاستعباد، وإقامة شبكات عالمية للاتجار بالأعضاء البشرية، عن طريق استدراج هذه الفئات المستهدفة بوسائل إلكترونية للإيقاع بهم، وقد أظهرت الدراسة موقف الشريعة الإسلامية والقانون من هذه الجرائم، واتفاق الفقهاء على عدم جواز بيع شعر الإنسان، أو عظمه، أو لحمه، أو أي شيء من أعضائه؛ لأن الآدمي مكرم فلا يجوز أن يكون شيء من أجزائه مهانا، وأصلت للتكييفات الفقهية الملائمة لمثل هذه الجرائم المستحدثة، والعقوبات المناسبة لها في الشريعة الإسلامية مقارنة بالقانون. This study aims at explaining the exact meaning of electronic human trafficking and the means used by criminals to carry out their various crimes via exploiting the global web (the internet) using various techniques for fraud on a certain group of people to make a trade on human's honor, body organs, or using full human energy to achieve financial returns via exploiting the human's body or his organs by buying or selling them as an ordinary product. The study also explained the different types of electronic human trafficking Which include: Sexual exploitation, for both Children and women, in addition, treating some people as slaves by founding international webs to buy and sell human's organs using electronic means to fetch or deceive the victim. The study explained the law and the Islamic Law's point of view toward the issue stressing the jurists' point of view for forbidding the process of selling: human's Hair, bone, flesh or any other organ because humans have a high dignity. The study also came on mentioning the different jurisprudential adaptation for the issue and the comparison between the punishment in the Islamic Law on one hand and the Law on the other one. |
