| 520 | |a تبرز أهمية دراسة جريمة الرشوة تلك الظاهرة الخطيرة عندما تجد المناخ الملائم لها مستغلة عجز التشريعات الجنائية وتطبيقاتها في القضاء عليها فلا بد من الحزم وتكاتف الجهود للتقصي عن تلك الجريمة وأسبابها وعدم التساهل في التصدي لها، فانتشارها وعدم الحد منها يعني استشراء الفساد في المجتمع وشيوع الرذيلة واختفاء العدالة وعدم المساواة في معاملة الأفراد وفقدان ثقة المواطن بالدولة ومؤسساتها الدستورية وأعمال موظفيها ونزاهتهم وضعف الإحساس بالمواطنة وما تفرضه من واجبات الحفاظ على تماسك المجتمع ونظمه، فلا بد من البحث عن تلك الجريمة وأسبابها وما تثيره من مشكلات قانونية مثل الاختصاصات الوظيفية اللازمة لكشف أركان جريمة الرشوة كغيرها من الجرائم الأخرى فلا بد من تبصير الآخرين بأن جريمة الرشوة هي من الجرائم الدنيئة واللا أخلاقية وأن مقترفها يستوجب العقاب الذي يستحقه كي يمكن بناء مجتمع ينعم بالرفاهية وتسود فيه قيم الأخلاق والعدل. |b The importance of studying the crime of bribery, this dangerous phenomenon, becomes apparent when it finds a suitable climate for it, taking advantage of the inability of criminal legislation and its applications to eliminate it.
