| المستخلص: | يمثل الغذاء أحد الحقوق الأساسية التي دعت إليها أغلب دساتير الدول بسبب أهميته واتصاله المباشر بحياة الإنسان ووجوده، لذلك سلطت دراستنا على هذا المحور وعلى أي سلوك يمثل تعديا عليه، وعليه تضمن بحثنا بعض الجرائم التي تمس هذا الحق، وكذلك بينا أحكامها وخصائصها وكذلك موقف المشرعين منها، أما عن مشكلة بحثنا هو عدم وجود قانون مختص يهتم بكافة هذه الجرائم حيث نجد أغلب هذه الجرائم متوزعة بين قانون العقوبات وبين قانون حماية المستهلك وبين قوانين إدارية أخرى، وأما عن منهجية البحث المتبعة فكانت التحليلي الوصفي حيث عملنا على وصف لتلك الجرائم وتحليل النصوص الخاصة بها، وتوصلنا إلى عدة نتائج أهمها هو وجود العديد من الجرائم التي تمس الغذاء بسبب التطور التكنولوجي الحديث واستغلال من قبل ضعاف النفوس. Food represents one of the basic rights called for by most of the constitutions of countries because of its importance and its direct connection to human life and existence, so our study focused on this axis and on any behavior that constitutes an infringement on it, and accordingly our research included some crimes that affect this right, as well as we explained their provisions and characteristics as well as the position of legislators towards them As for the problem of our research, it is the lack of a specialized law that deals with all these crimes, as we find most of these crimes distributed between the Penal Code and the Consumer Protection Law and other administrative laws, and as for the research methodology used, it was descriptive analysis, where we worked on a description of these crimes and the analysis of their texts And we reached several results, the most important of which is the existence of many crimes that affect food due to modern technological development and exploitation by weak souls. |
