| المستخلص: | بين البحث أن الحكم الشرعي مبني على صحة النظرية العلمية القائلة بإمكان حدوث هذه العملية، إذ أن البحث الفقهي لم ينضج بعد بشكل كامل حول موضوع الاستنساخ. أكد البحث على أن الكثير من الكلام الذي يقال هنا وهناك، سواء في مقام التأييد أو الرفض هو كلام خطابي انفعالي، إما تحمسا للعلم وأما تنفرا من الاحتمالات التي تكتنف الاستنساخ. تكمن إشكالية البحث حول سد الذرائع المفضية إلى الممنوع، أصل من أصول الدين الحنيف، فأي وسيلة تفضي إلى الوقوع في الحرام فإنها حرام. والاستنساخ البشري يفضي إلى استئجار الأرحام وهو حرام ويفضي إلى ترك الزواج، وليس ترك الزواج من دين الإسلام في شيء. تكمن أهمية البحث على المحافظة على النسب يعتبر إحدى الضرورات الخمس التي جاءت كل الشرائع بالمحافظة عليها. والإقدام على تطبيق الاستنساخ في الإنسان لا ينفك عن الوقوع في تجهيل الأنساب، وانقطاع التناسل الذي ناط الله تعالى به القرابة بأنواعها، وهو بهذا التطبيق يفضي إلى اختلاط الأنساب وانقطاع التناسل وهذا محرم شرعا. خلص البحث على أن الاستنساخ البشري اللاجنسي مخالفة لما تضمنته البحث حيث فيه قضاء على نظام الأسرة وكيانها، فإن المنجزات الجديدة في علوم الهندسة الوراثية تقضي على مفهوم الأمومة، وانتهاء عصر الرجال وزمن الأزواج. The research showed that the legal ruling is based on the validity of the scientific theory that this process can occur, as jurisprudential research has not yet fully matured on the issue of cloning. The research confirmed that much of the talk said here and there, whether in terms of support or rejection, is rhetorical and emotional, either out of enthusiasm for science or out of aversion to the possibilities surrounding cloning. The problem of researching lies in blocking the pretexts that lead to the forbidden, one of the principles of the true religion, as any means that leads to falling into the forbidden is forbidden. Human cloning leads to surrogacy, which is forbidden, and leads to abandoning marriage, and abandoning marriage has nothing to do with the religion of Islam. The importance of research lies in preserving lineage, as it is considered one of the five necessities that all laws are required to preserve. Attempting to implement cloning in humans inevitably falls into the ignorance of lineages and the cessation of reproduction, which God Almighty has entrusted to all kinds of kinship. With this application, it leads to mixing of lineages and the cessation of reproduction, and this is forbidden by law. The research concluded that asexual human cloning is contrary to what was included in the research, as it eliminates the family system and its entity. The new achievements in genetic engineering science eliminate the concept of motherhood, and the end of the era of men and the era of husbands. |
