| المستخلص: | تناول هذا البحث الحديث عن مدى تأثير الأوبئة في استحالة تنفيذ ما يترتب على المتعاقدين في عقد العمل، حيث يبين فيه أثر الاستحالة في تنفيذ التزامات العامل، بتوضيح ماهية الاستحالة وما يتعلق بها من أنواع وشروط وأسباب، منها إصابة العامل بالوباء أو الحجر الصحي أو فرض حظر التجول من قبل الدولة، ثم قام ببيان بعض آثار استحالة تنفيذ التزامات صاحب العمل بسبب الوباء، مثل الإغلاق وشرح أسبابه وشروطه، أما الخاتمة فقد جاءت متضمنة لأهم النتائج التي خلص إليها البحث، منها: إذا كانت استحالة تنفيذ الالتزام مؤقته، فلا ينفسخ العقد؛ بل يقف تنفيذه حتى تزول الاستحالة، ويعتبر حظر التجول والمرض والحجر الصحي من أسباب استحالة تنفيذ العامل لالتزاماته، وأنه إذا كان الإغلاق راجع إلى قوة قاهرة أو لسبب أجنبي لا يد لصاحب العمل فيه والمؤدي إلى الاستحالة النهائية في التنفيذ، يستتبع ذلك انفساخ عقد العمل بقوة القانون.
