| 520 | |a يختلف النظام القانوني للجريمة التأديبية عن النظام القانوني للجريمة الجنائية؛ من حيث: استقلال الطبيعة القانونية، والهدف الذي يسعى كل منهما لتحقيقه، وكذلك يختلف من ناحية الإجراءات القانونية المتبعة، فجوهر الجريمة التأديبية يقوم على المخالفة المرتكبة من قبل الموظف للواجبات الوظيفية التي يعود تقديرها لنظام الوظيفة العامة، أما الجريمة الجنائية فجوهرها يستند إلى السلوك الجرمي الذي ترتب عليه انحراف الشخص المتهم عما تنهى عنه القوانين الجنائية وعلى رأسها القانون الجنائي. ومن خلال التطبيق العملي يلاحظ أنه قد يتضمن ذات السلوك المرتكب من قبل الموظف العام خطأ وظيفيًا وجريمة جنائيةً؛ وهو ما يترتب عليه وجوب مساءلة هذا الموظف تأديبيا لوجود حق عام للسلطة الإدارية للحفاظ على عمل المرافق العامة باضطراد وانتظام، وكذلك مساءلته جنائيا لوجود حق عام للدولة للحفاظ على أمن المجتمع واستقراره، لذلك ولكون هذه الأحكام تتداخل ويؤثر بعضها على البعض الآخر، كان من الضروري الحديث عن الحجية التي تتمتع بها الأحكام الجنائية الصادرة بصورة باتة وقطعية أمام سلطات التأديب الإدارية، خصوصًا الأحكام الصادرة بالبراءة ومدى تأثيرها على الموظف. |b The legal system for disciplinary offense differs from the legal system for criminal offense in according to: Independence of the legal nature, the goal seeks to achieve, It also differs in terms of the legal procedures followed, as the essence of the disciplinary offense is based on the violation committed by the employee to job duties, which is appreciated by the civil service system, As the criminal offense, its essence is based on the criminal behavior that resulted in deviation of the accused person from what criminal laws forbade him, foremost of which is the criminal law.
