| المستخلص: | تعد جريمة التهجير الداخلي للسكان المدنيين إبان النزاعات الداخلية من أخطر الجرائم الدولية في العصر الحديث، سواء من حيث عدد الأشخاص المهجرين أم من حيث المشاهد المأساوية التي يتعرض لها السكان المدنيون في مناطق النزاع داخل إقليم الدولة. فقد أجمعت التقارير الدولية الصادرة عن المنظمات الدولية، على مسؤولية النظام السوري عن جريمة التهجير الداخلي للنازحين السوريين بعد اندلاع الثورة السورية في 15 مارس 2011 وما تبعها من انتهاكات لمبادئ القانون الدولي وحقوق الإنسان من قبل القوات الحكومية السورية والمليشيات المسلحة التابعة لها؛ ما أدى إلى زيادة أعداد المهجرين السوريين إلى المناطق الآمنة المجاورة أو مراكز الإيواء داخل الإقليم السوري. وعليه تناولت هذه الدراسة الحماية القانونية للمهجرين داخليا، وذلك من خلال بيان تعريف المهجر داخليا، والحماية المقررة للمهجر في ضوء قواعد القانون الدولي، ومدى انطباق قواعد المسؤولية الدولية على انتهاكات النظام السوري في قضية التهجير الداخلي للسكان المدنيين. Internal displacement of civilians amid civil conflicts is considered one of the most heinous crimes in modern history, either in terms of the number of displaced citizens or the horrendous atrocities inflicted to the civilian population in the conflict zones. Reports by international organizations unanimously agreed on the responsibility of the Syrian regime for the displacement of Syrian refugees after the outbreak of the Syrian revolution on March 15, 2011 and the subsequent violations of the principles of international laws and human rights by the government forces and the affiliated militias, which caused the significant increase in the number of displaced Syrians to the adjacent safe areas or to the shelter centers inside the Syrian territory. This study discusses the legal protection of the displaced population by introducing a definition of the term “displaced population“ and highlighting the related protection enshrined in the International Law. In addition, the study assesses the application of the rules of international responsibility to the violations of the Syrian regime in the issue of displacement of civilian population. |
