| المستخلص: | يهدف هذا البحث إلى دراسة اللسانيات القضائية وفروعها بوصفها فرعا من اللسانيات التطبيقية يتناول اللغة بوصفها وسيلة تواصل في الممارسة المهنية القضائية بتجلياتها المتعددة قضاء وتحقيقا وحكما، ويوثق انتسابها إلى اللسانيات التطبيقية. وتتمثل مشكلة البحث في أن اللسانيات الجنائية مجال حديث لم يلق العناية الكافية في الدراسات العربية، وما يزال يعاني ضعفا ظاهرا في التنظير له بوصفه مجالا لسانيا تطبيقيا بينيا يمكن أن يسهم في حل كثير من المشكلات التواصلية والقانونية في المحاكم ومراكز الشرطة ومؤسسات صناعة القرار واتخاذه، ويتجاوز ذلك إلى المساهمة في حل قضايا الإرهاب الدولي. وقد تمثل هذا البحث المنهج الوصفي في حدوده الواسعة الممتدة بين الوصفي التقريري والوصفي التحليلي من ناحية؛ فهو يقرر ما استقر لدى اللسانيين من مفاهيم ومبادئ، ويحلل المواقف المشخصة لينتهي إلى نقلها من النظري إلى التطبيقي؛ للتدليل على الجوانب اللسانية التطبيقية في اللسانيات الجنائية. ولبلوغ هذه الغاية فإن البحث يؤسس لوجوه المقاربة اللسانية للنصوص القضائية والقانونية بوصفها خطابا وممارسة اجتماعية يومية، وبوصفها نشاطا إنسانيا يؤدى بلغة المجتمع ووفقا لأعرافه وتقاليده التواصلية والتداولية والثقافية. كما يعاين البحث المجالات المشهورة في الدرس اللساني القضائي. ثم كان المبحث الثاني بيانا معرفيا لبينية اللسانيات القضائية وتعالقها مع علوم لسانية متنوعة كاللسانيات الاجتماعية، ولسانيات المتون وعلم اكتساب اللغة الثانية وتعليمها... إلخ. وقد حاول المبحث الثالث الوقوف عند التحديات التي تواجهها اللسانيات القضائية، والفرص التي يمكن اختلاقها من هذه التحديات ومن ثم استثمارها في تطوير هذا العلم اللساني الشاب. وقد توصلت هذه الدراسة إلى انتساب اللسانيات القضائية إلى اللسانيات التطبيقية بوصفها استثمارا للرؤى اللسانية النظرية المستمدة من القانون واللسانيات العامة ونظريات اكتساب اللغة والتداوليات في حل مشكلات تواصلية وقانونية وجنائية واقعية تواجهها المجتمعات الإنسانية كافة. وتؤكد الدراسة أهمية البحث في اللسانيات الجنائية، وضرورة رعايتها في الدوائر الأكاديمية العربية: جامعاتها ومعاهدها ومؤسساتها القضائية والقانونية الرسمية؛ لما ثبت من نجاعتها في خدمة القانون والقضاء. This study aims at examining Forensic Linguistics, a branch of Applied Linguistics, which addresses language as a means of communication used in forensic, professional practices and manifested in judiciary, investigations, and verdicts. Forensic Linguistics is a recent discipline; hence theoretical forensic research is relatively new and still receives inadequate attention in Arab studies although it contributes to solving not only communicative and legal problems in courts, police stations, and decision-making institutions but also issues related to international terrorism. This study adopts the descriptive reporting and analytical methods. The former focuses on theoretical, linguistic concepts as well as principles, and real-life examples while the latter analyzes such principles and concepts pinpointing applied linguistics aspects manifested in Forensic Linguistics. This study addresses three dimensions. The first dimension compares linguistic texts to forensic and legal ones since they act as a means of societal communication, a daily and social practice, and a humanitarian activity that reflects the communicative, pragmatic and cultural traditions, beliefs, and norms of any society. The second one presents a theoretical background in Forensic Linguistics and its connection to other linguistic branches such as Sociolinguistics, Pragmatics, and Second Language Acquisition... etc. The third one sheds light on challenges that encounter Forensic Linguistics and that opportunities must be seized to develop this young science in Arabic studies. This study finds that Forensic Linguistics ties up with Applied Linguistics. That is, Forensic Linguistics is an effective means to solve communicative, judicial, and forensic problems that encounter societies. Besides, it is a real application to linguistic theories and perspectives derived from law, general linguistics, theories of language acquisition, and pragmatics. This study also discusses the importance of examining Forensic Linguistics in Arab studies and involving it in Arab academic institutions such as universities, colleges and judicial institutions, for proving its effectiveness in the service of the law and judiciary. |
