| 520 | |a يبين البحث المعنى المراد بتحليل النصوص الفقهية، وهو لفظ يرد في كلام الفقهاء في أول كتب الشروح، وعند بيان كيفية قراءة الفقه على الفقهاء، وأن ذلك يتضمن حل ألفاظ الكتاب الفقهي أو النص الفقهي. فيهدف البحث إلى بيان معنى التحليل، مع بيان الأسباب التي تدعو إلى تحليل النصوص، مع بيان ثمرة ذلك وفائدته. والمنهج المتبع في هذا البحث هو المنهج الوصفي. فيبين البحث مقصود الفقهاء من تحليل النصوص، وأنهم يعنون به حل الألفاظ الواردة في النص، ببيان معانيها حالة الإفراد، ومواقعها من الكلام حالة التركيب؛ ليتوصل بذلك إلى بيان منطوق الكلام ومفهومه على ما أراده المتكلم. ويرد في البحث ذكر عناصر هذا التحليل. وأن كشفها وبيانها ضرورة قائمة على اعتبار النصوص الفقهي نصوصا صيغت بعناية ظاهرة ودقة بالغة. فهي نصوص منهجية ذات أنساق دلالية وحجاجية جدلية، صيغت بأساليب علمية لها مقدماتها وشروطها، ولا يمكن فهمها دون استحضار تلك المقدمات وإعمال الذهن فيها. ولتحليل تلك النصوص ثمرات كثيرة، منها حسن التفهم لنصوص الفقهاء، وكشف مثارات الغلط في فهمها، وأثر ذلك في بناء الملكة الفقهية وترتيب مسالك التفقه. ويوصي البحث بملاحظة عناصر التحليل عند بناء المقررات الفقهية الجامعية وغيرها؛ لما لذلك من أثر في الفهم والتنزيل. |b The research shows the meaning intended by analyzing the jurisprudential texts, which is a term appears in the jurists' phrases at the beginning of explanations books, and when explaining how to read jurisprudence through jurists, and that includes solving the jurisprudential book contents of or the jurisprudential text. This research aims to explain analysis meaning and stating reasons lead to analyzing texts, as well as to figure out its core and benefit. The method used in this research is the descriptive method. The research shows the jurists intent about texts analyzing, and they mean the items or words contained in the text, by explaining its meanings in the case of singularities, and its positions in speech in case of composition. In order to reach a statement of speech utterance and its meaning according to the speaker intent. In the research mentions the elements of this analysis. Also, its revealing and clarifying is a necessity based on considering the jurisprudential texts as texts formulated with apparent care and extreme accuracy. They are systematic texts with semantic and argumentative formats, formulated using scientific methods that have its own prefaces and conditions, and it cannot be understood without evoking those prefaces and realizing mind therein it. The analysis of these texts has many benefits, including a good understanding of the jurists' texts, and the detection of the causes of error in its understanding, and the impact of that on the structure of jurisprudential ability and in arranging the paths of jurisprudence. The research recommends noting the elements of analysis when building university and other jurisprudence courses contents and other structures.
