| المستخلص: | يعد النسخ من المسائل التي شغلت بال كثير من علماء الشريعة بين الإثبات والنفي؛ كونها من المسائل المختلف فيها؛ فتنالوها بالتأليف في كتاباتهم سواء بالتضمين في موضوعات أصول الفقه أو بالإفراد في مؤلفاتهم. وهذا يعطينا إشارة لمدى أهمية الموضوع وتأثيره في استنباط الأحكام الشرعية من النصوص عند الفقهاء. يدور البحث حول حقيقة وقوع النسخ في آيات القرآن الكريم سواء أكان في آيات كريمات أخرى أو في السنة. تنحصر جهودنا المتواضعة في استقراء مسائل معنية بالموضوع من خلال سرد أقوال العلماء من القدامى والمحدثين ثم تتبعها من خلال معرفة رأي العلماء فيها من كتب الناسخ والمنسوخ ثم التعقيب عليها وفق ما من الله سبحانه وتعالى علينا من معرفة بالعلوم الشرعية. لم يكن البحث الوحيد ولا الفريد من نوعه؛ لأن هناك من سبقنا إليه بالبحث والتأليف؛ فكان لهم السبق والفضل بالرجوع إليهم والنهل من علمهم والاعتماد على رأيهم والاستفادة من كتبهم، لكن حاولنا وهذا جهد المقل أن نكتب فيهما اختلفوا فيه، وأن نتخطى ما وقعوا فيه من سهوا أو خطأ في اجتهادهم أو تناسوه لعدم استحصالهم للدليل من الكتاب المجيد أو السنة المشرفة. Copying is one of the issues that preoccupied many scholars of Sharia between affirmation and negation; Because it is one of the different issues; They obtained it by authorship in their writings, whether by inclusion in the topics of the principles of jurisprudence or individually in their books. This gives us an indication of the importance of the topic And its influence in deriving legal rulings from the texts of the jurists. Research is about a fact copy occurred in Verses of the Quran Whether it is in other noble verses or in the Sunnah. Our modest efforts are limited to extrapolating relevant issues By listing the sayings of ancient and contemporary scholars Then follow it by knowing the opinion of scholars on it From the transcribed and abrogated books Then comment on it according to what Alla Almighty has bestowed upon us in terms of knowledge of Sharia sciences. The research was neither the only nor the one of its kind; Because there are those who preceded us with research and writing ; They were credited with returning to them and the people of their knowledge relying on their opinion and benefiting from their books, But we tried to write about the two of them who differed about it And to overcome what they have fallen into in terms of inattention or error in their diligence Or they forgot it because they did not obtain the evidence from the glorious Book or the honorable Sunnah. |
