| المستخلص: | لا ينفك أفراد المجتمع البشري عن التنازع في شتى المجالات، وملكية الأرض تُعد من أكثر الأمور شيوعاً في هذه النزاعات، إذ تأخذ نزاعات الملكية صوراً متنوعة، فمنها ما ينشأ بين الأفراد والجماعات، ومنها ما ينشأ بينهم وبين الدولة حول ملكية الأرض، مُشكّلَةً بذلك أعتى صور مهددات السلام. لقد لعب التنازع حول الملكية في العراق دوراً بارزاً في زعزعة السلم الأهلي عبر تاريخ العراق الحديث، ورغم المحاولات التي بذلها المشرع في حلها أو الحد منها إلا أنها مازالت مستمرة، ونظراً لتعدد حالات التنازع فقد تخصص هذا البحث في محاولة فهم عمل هيأة حل نزاعات الملكية في العراق باعتبارها إحدى مؤسسات العدالة الانتقالية وبناء السلام. وقد لاحظنا خلال البحث أن هنالك نزاعات مستمرة لم تشملها بنود قانون هيأة حل نزاعات الملكية ومازالت تهدد السلم المجتمعي، وكذلك لاحظنا الدور الاجتماعي الفعال للهيأة- محل الدراسة- في للحد من نشوء الصراع الذي كان متوقعاً بعد عام ۲۰۰۳م بسبب عودة المسفرين والمهجرين قسراً من خارج البلد، وقد حدانا البحث نحو تقديم بعض التوصيات واقتراح بعض الاستراتيجيات التي من شأنها المساهمة بناء السلام والمعالجة المستدامة لأزمات نزاعات الملكية. The members of human society keep on conflicting in various fields, and land property is one of the most common things in these conflicts, as property disputes take a variety of forms, some of which arise between individuals and groups, and what arises between them and the state over land property, thus forming the most powerful forms Peace threats. Conflict over property in Iraq has played a prominent role in destabilizing civil peace throughout the history of modern Iraq, and despite the attempts made by the legislator to resolve or limit it, it is still ongoing, and due to the multiplicity of cases of conflict, this research has specialized in trying to understand the work of the Authority for the Resolution of Property Disputes in Iraq as one of the institutions of transitional justice and peacebuilding. We have noticed during the research that there are ongoing disputes that were not covered by the provisions of the Law of the Authority for the Resolution of Property Disputes and still threaten societal peace, as well as we noticed the effective social role of the Authority in reducing the emergence of conflict, which was expected after 2003 AD due to the return of travelers and forcibly displaced people from outside the country. Towards presenting some recommendations and proposing some strategies that would contribute to building peace and sustainable treatment of crises of property disputes. |
