| 520 | |a يتناول موضوع الدراسة الحالية مسألة حماية الحياة الخاصة في ظل نظام مكافحة الجرائم المعلوماتية السعودي. فمن سمات الحياة المعاصرة ارتباطها بالتقنيات التكنولوجية المعلوماتية، والتي تم توظيفها بشكل اعتمدت عليه الحكومات والبنوك والشركات وكافة المؤسسات بأنواعها وكذلك الأفراد، وتعلقت بها كافة المصالح. وتسببت تلك التكنولوجيا في انتهاكات جسيمة للحياة الخاصة. وحيث تعد حماية الحياة الخاصة من أهم الموضوعات في مجال حقوق الإنسان، وذلك راجع إلى ارتباط الخصوصية في النهاية بممارسة الحياة العامة، وعليه فإن كفالة وكرامة الإنسان وآدميته ينبغي أن تسعى القوانين لحمايته. وللدراسة أهمية خاصة في الإطار الزماني المعاصر، والذي يتسم بتعدد التهديدات التي تطال حرمة الحياة الخاصة في ظل التطور التكنولوجي الذي مكن التطبيقات والبرامج المعلوماتية من اكتساح فضاء الخصوصية بسهولة والتعرف على المعطيات الشخصية لمستعملي هذه البرامج. حيث أن غياب التأطير القانوني لاستعمالات ها من شأنه أن يهدد الحق في حماية الحياة الخاصة، والتي اتفقت القوانين الوطنية والاتفاقيات الدولية على الاهتمام بها وإعطائها صبغة دستورية. وتهدف الدراسة بوجه عام إلى تثقيف الفرد بحقوقه القانونية في حال انتهاك حرمته الخاصة سواء عن طريق السرقات الإلكترونية أو التعديات على الحياة الشخصية للفرد. كما أن هدفها الخاص هو تناول موضوع ضمانات الحياة الخاصة في ظل نظام مكافحة الجرائم المعلوماتية السعودي. |b The subject of the current study deals with the issue of protecting private life in light of the Saudi anti information crime system. One of the features of contemporary life is its connection with information technology, which have been employed in a way that governments, banks, companies and all types of institutions have relied on, as well as individuals, and all interests depend on them. And that technology caused massive violations of private life. Whereas the protection of private life is one of the most important issues in the field of human rights, due to the link between privacy and the practice of public life, and accordingly, ensuring the dignity and humanity of the human being should be sought by laws to protect it. The study has important particular in the contemporary time frame, which is characterized by the multiplicity of threats to the sanctity of private life in light of the technological development that has enabled applications and information programs to easily sweep the privacy space and identify the personal data of the users of these programs. Whereas the absence of legal framing for its uses would threaten the right to protect private life, which national laws and international agreements have agreed to take care of and give it a constitutional character. The study aims in general to educate the individual of his legal rights in the event that his privacy is violated, whether through electronic theft or attacks on the personal life of the individual. Its special goal is to address the issue of safeguards for private life in light of the Saudi anti-information crime system. | ||
