| المستخلص: | لقد أدى التطور التكنولوجي والتقدم العلمي إلى استخدام تكنولوجيا الهندسة الوراثية في مجال إنتاج وتداول الغذاء على نطاق واسع، وذلك لمواجهة المجاعات وسد الفجوة الغذائية الناتجة عن الزيادة السكانية الكبيرة في ظل محدودية الموارد الطبيعية المتاحة، ومن أجل تحقيق أكبر قدر من الحماية اللازمة للمستهلك وتأكيد حقه في تعويض الأضرار الناتجة عن استهلاك الغذاء المعدل وراثيا، قامت معظم الدول خاصة المستوردة لهذا النوع من الغذاء بالبحث عن الآليات الفعالة لتحقيق ذلك في ظل قصور قواعد المسئولية المدنية التقليدية في توفير الحماية الكافية للمستهلك.. قد تناولت من خلال هذا البحث الأساس القانوني للمسئولية المدنية عن الأضرار الناشئة عن استعمالات الهندسة الوراثية في مجال الغذاء وتسليط الضوء على تلك المسئولية في كل التشريعات الوطنية والمقارنة، من خلال عرض المسائل القانونية ذات الصلة وإبراز أوجه القصور فيها وتوضيح المشكلات الناتجة عنها ورغبة في حس الشركات المنتجة للغذاء المعدل وراثيا على تحسين جودة منتجاتهم وعدم طرحها للتداول قبل التأكد التام من صلاحيتها للاستهلاك وتوافر عامل الأمان فيها. Technological development and scientific progress have led to the use of genetic engineering technology in the field of food production and circulation on a large scale, in order to confront famines and bridge the food gap resulting from the large population increase in light of the limited available natural resources, and in order to achieve the greatest degree of necessary protection for the consumer and confirm his right to food. Compensation for damages resulting from the consumption of genetically modified food, most countries, especially those importing this type of food, have searched for effective mechanisms to achieve this in light of the inadequacy of the traditional civil liability rules in providing adequate protection to the consumer. Through this research, the legal basis for civil liability for damages arising from the uses of genetic engineering in the field of food and shedding of This responsibility is highlighted in all national and comparative legislation by presenting the relevant legal issues, highlighting their shortcomings, clarifying the problems resulting from them, and the desire of the companies producing genetically modified food to improve the quality of their products and not put them into circulation before making sure of their suitability for consumption and the availability of the safety factor in them. |
