| المستخلص: | من أهم المرتكزات الأساسية والتي يقوم عليها ممارسة النشاط التجاري، السرعة والدقة في جميع تعاملات التاجر التجارية. بما يحافظ على ائتمانه التجاري، حيث تفرض الطبيعة القانونية للنشاط التجاري على من يزاوله سواء كان تاجرا فردا أو شركة تجارية القيام بالعديد من المعاملات والعلاقات التجارية مع الغير بما يناسب طبيعة النشاط التجاري. وقد يواجه المشروع التجاري على أثر هذه التعاملات التجارية والظروف الاقتصادية الداخلية والخارجية، العديد من الاضطرابات المالية، أثناء ممارسته لنشاطه، ولتجنب دخول المشروعات التجارية في هاوية شهر الإفلاس، وتصفيتها وإنهاء نشاطها، تطورت فلسفة ونظرت التشريعات الحديثة، للمدين المتوقف عن الوفاء بديونه إيمانا منهم بمدى أهمية وجود تلك المشروعات في الحياة الاقتصادية والاجتماعية. ولذلك كان لابد من تحديد مفهوم إعادة هيكلة المشروعات التجارية المتعثرة. وتحديد الأسباب المختلفة لتعثر المشروعات التجارية. وتحديد إجراءات إعادة هيكلة المشروعات التجارية المتعثرة.
