| 520 | |a جاء هذا البحث لبيان أحكام الطلاق الإلكتروني والآثار المترتبة عليه، مشتملا على مقدمة، ومبحثين، وخاتمة: أما المقدمة فذكرت فيها، أهمية الموضوع، وسبب اختياره، والدراسات السابقة، وأما خطة البحث فقد اشتملت على مبحثين، وخاتمة. أما المبحث الأول: فجاء لبيان مفهوم الطلاق، وحكمته، وأركانه، ويشتمل على مطلبين: المطلب الأول: مفهوم الطلاق، وحكمته، والمطلب الثاني: أركان الطلاق. وجاء المبحث الثاني لبيان: صور الطلاق الإلكتروني، وطرق إثباتها، والآثار المترتبة عليها، ويشتمل على ثلاثة مطالب: المطلب الأول: حكم الطلاق الإلكتروني بواسطة رسائل الهاتف النقال، وطلاق الإنترنت بالبريد الإلكتروني والمحادثة الكتابية، والطلاق بوسائل الاتصال الأخرى. المطلب الثاني: طرق إثبات الطلاق الإلكتروني، والمطلب الثالث: الأحكام والآثار المترتبة على الطلاق الإلكتروني. وقد انتهى البحث إلى مجموعة من النتائج أبرزها: أن الطلاق الإلكتروني يقصد به حل رابطة الزواج بلفظ مقصود من الزوج صراحة، أو كناية، أو بالفعل الصريح، أو الكنائي عبر وسائل الاتصال الحديثة، كالاتصالات الخلوية، والرسائل النصية (SMS)، أو برامج المحادثة الفورية، أو البريد الإلكتروني، وهو طلاق مكروه لا حاجة إليه؛ لما فيه من التسرع، والضرر الواقع، أو المتوقع بالأسرة، والتجاحد أو النكران للحقوق، كما أنه يعد ذريعة للإفساد والتلاعب بأمن المجتمع واستقراره. |b This paper describes the provisions and implications of electronic divorce, including an introduction, two researchers, and a conclusion: the introduction states the importance of the topic, the reason for its choice, previous studies, and the research plan includes two researchers and a conclusion. The first is the concept of divorce, its wisdom, and its pillars. It contains two requirements: the first is the concept of divorce, its wisdom, and the second is the elements of divorce. The second study of the statement: electronic divorce images, ways of proving it, and its effects, and includes three demands: the first: the ruling of an electronic divorce by mobile phone, the divorce by email and written conversation, and divorce by other means of communication. Second requirement: methods of establishing electronic divorce, and third requirement: the provisions and implications of electronic divorce. The research has yielded a number of findings, most notably: electronic divorce is intended to dissolve the marriage by an intentional pronunciation of the spouse, metaphorical, explicit or obscure means of communication, such as cellular communication, text messaging (SMS), instant chat programs, or e-mail, which is an unnecessary abomination; because of its haste, actual or expected harm to the family, and its obstinacy or denial of rights, and it is also considered a pretext for corruption and tampering with the security and stability of the society. | ||
