| 520 | |a إن الوقوف على مسالك نظر الفقهاء المجتهدين في الأدلة لاستخراج الأحكام الشرعية من الأهمية بمكان، وقد نص العلماء على ضرورة اتصاف المستدل بأحوال منها: إدراك الواقع، لأن تنزيل الحكم الشرعي على حادثة فرع عن تصورها، وإن من أهم صور إدراك الواقع: معرفة مآلات الأفعال. وقد فعل الأصوليون مبدأ اعتبار مآلات الأفعال في الاجتهاد الشرعي، بل إن صنيعهم يدل على أنه من أهم قواعد مقاصد الشريعة، بل يشبه أن يكون نظرية متكاملة تندرج تحتها قواعد أصولية ومقاصدية كثيرة، كقاعدة الذرائع سدا وفتحا، وقاعدة مراعاة الأعراف، وقاعدة مراعاة الخلاف، وقاعدة تغير الأحكام باختلاف الأحوال والأشخاص والأزمنة والأمكنة، والاستصلاح، والاستحسان، والحيل، ومقدمة الواجب، والوسائل وغاياتها. ولما كانت هذه القاعدة مناط اجتهاد واسع ودقيق من قبل الأئمة والفقهاء، كثرت الفروع الفقهية المخرجة عليها، وأفضى ذلك إلى إثرائها وتوسيع الكلام فيها. وفي هذا البحث تأصيل لهذه القاعدة وبيان اهتمام الحكيم الترمذي بها وتنزيله الفروع عليها في محاولة لبيان مناهج العلماء المتقدمين في التقعيد والتطبيق المقاصدي والأصولي. |b It is of great importance to examine the methods of judgements by scholars who are diligent about the evidence in order to extract legal judgments. Scholars have stated that the reasoning should be based on conditions such as: a perception of reality, since the forensic judgment of a branch incident is based on its perception, and one of the most important aspects of reality is knowledge of the consequences of actions. The fundamentalists did practice the principle of considering the effects of deeds in Islamic jurisprudence. Their practice indicates that it is one of the most important principles of Islamic law, and is similar to being an integrated theory that encompasses many fundamental and intentional rules, such as the rule of excuses, whether it is a black or an open one, the rule of observance of customs, the rule of consideration of disagreement, the rule of changing judgments according to circumstances, persons, times and places, reclaiming, approving, approving, giving of duty, and means and their objectives. Since this rule is the subject of broad and precise jurisprudence by imams and jurists, the jurisprudence branches produced therein have proliferated, which has led to its enrichment and the expansion of speech. In this research, this rule is rooted, and it shows the interest of the wise person, as well as its branches, in an attempt to clarify the approaches of advanced scientists in complexity, intent, and fundamentalism. | ||
