| المستخلص: | تهدف هذه الدراسة الموسومة بـ: "الفكر الأصولي عند ابن بطال من خلال شرحه لصحيح البخاري" للتعريف بهذه الشخصية المالكية الأندلسية الفذة، وبآرائه الأصولية، وخاصة من خلال عنايته بالأحكام الفقهية التي تشتمل عليها أحاديث النبي صلى الله عليه وسلم، حيث يشكل هذا العلم المنارة الوضاءة بين العلوم الشرعية، وذلك أنه عبارة عن المبادئ والقواعد التي سار عليها الفقهاء في استخراج الأحكام وبيانها للناس، ومعالجة بعض القضايا التي تطرأ، وغير ذلك من تفسير النصوص، وبيان دلالات الألفاظ والتوفيق بين الأدلة، وكيفية الترجيح، ومنهج الاجتهاد ومقوماته، وفق منهج محدد يسير عليه العالم في الاجتهاد والاستنباط، والناظر لمنهجه وكتابه، يتضح له جليا مدى تمكنه وإلمامه بعلم أصول الفقه وقواعده الكلية من خلال تخريجه للفروع الفقهية من خلال القواعد الأصولية، حيث أظهر ذلك من خلال النماذج التطبيقية لمبحث القياس. This study, titled: "The Fundamentalist Thought of Ibn Battal Through His Explanation of Sahih Al-Bukhari", in view of what distinguishes him in his approach, especially through his care for the fundamentalist rulings that are included in the hadiths of the Prophet, may God bless him and grant him peace, as this science constitutes the beacon of ablution among the sciences. Legitimacy, because it is the principles and rules followed by the jurists in extracting rulings and explaining them to people, and dealing with some of the issues that arise, and other than the interpretation of texts, and clarifying the semantics of words, and reconciling between evidence, and the method of weighting, and the approach of ijtihad and its components, according to a specific approach that he follows. The scholar in diligence and deduction, and the beholder of his approach and his book, it becomes clear to him the extent of his mastery and familiarity with the science of the principles of jurisprudence and its general rules through his graduation of the jurisprudential branches through the fundamentalist rules, as he showed this through the applied models of the study of analogy. |
