| المستخلص: | يروم هذا البحث إبراز أهمية الوعي بالوظائف الأساسية "لعلم أصول الفقه"؛ المتمثلة في البناء السليم للعقل المسلم؛ وتنظيم منهجية الاجتهاد الشرعي، والتفاعل مع النوازل والمستجدات الفرعية، وخدمة خصائص الدين المتميزة؛ بالمرونة، والتيسير، وعموم الخطاب، والصلاحية لكل زمان ومكان، وهذا ما استلزم على أهل الشأن -ولا يزال -ضرورة السير بهذا الفن في مسالك التجديد خدمة لتلك الوظائف؛ قصد مسايرة المستجدات والمتغيرات المتسارعة في مختلف المجالات: الاجتماعية، والثقافية، والاقتصادية، والإعلامية، وغيرها. وقد خلص البحث إلى أن تجديد الاتصال بين أصول الفقه ومستجدات العلوم الإنسانية؛ يعد من المنطلقات الأساسية للتجديد الأصولي المنشود؛ الذي يقوي وظائف علم الأصول؛ وخاصة وظيفة الاجتهاد التنزيلي؛ وما يتعلق بها من إدراك للواقع بمختلف متغيراته، وتحقيق المناط الخاص بالمكلف. Since “jurisprudence” was one of the unique sciences that reconstructed the Muslim mind through the organization of the process of jurisprudence, the interaction with the advents and sub-developments, and regarding it as an essential means of the renewal of religion, serving its characteristics of flexibility, facilitation, and general discourse, and validity for every time and place. This art needed to be open towards modern sciences as well as create communicational links with it; and to draw on the methodological mechanisms and rules achieved for the original functions for which it was established. The renovation of communication between the origins of jurisprudence and the updates of the human sciences is considered an essential starting point for the desired fundamental renewal, which revives the functions of this science and pushes its rules to interact with the rapid developments of the era in different domains would it be social, cultural, economic, media, etc. |
