| المستخلص: | هذا بحث بعنوان: (المدخل إلى نظرية الإثبات في النظام السعودي)، هدف إلى بيان التوجه العام للمنظم السعودي فيما يتعلق بمسائل الإثبات من خلال نصوصه النظامية الواردة في نظام الإثبات السعودي الصادر بالمرسوم الملكي رقم (م/ 43) وتاريخ 26/ 5/ 1443ه، ومن ثم كان هذا البحث لدراسة النظرية العامة للإثبات مع بيان ما أخذ به المنظم السعودي؛ لتكون هذه الدراسة كالقاعدة التي توضح الخارطة العامة لأحكام هذا الموضوع وحدوده، وكالمقدمة والمدخل والتوطئة للدراسات المتعمقة في تفاصيله وأحكام كل طريق من طرق الإثبات الواردة فيه، وقد جاء البحث في مقدمة وتمهيد ومبحثين وخاتمة، خصص التمهيد لبيان المقصود بمفردات عنوان البحث، بينما جاء المبحث الأول لبيان الأحكام العامة للإثبات، موضحا فيه مكان أحكام الإثبات في الأنظمة وكتب الشراح والفقهاء، والمذاهب القانونية والفقهية في الإثبات، وأشخاص الإثبات، في حين جاء المبحث الثاني للحديث عن القواعد العامة للإثبات، مبينا فيه ما يتعلق بالقواعد الموضوعية وكذا القواعد الشكلية. This is a research entitled: (Introduction to the theory of proof in the Saudi system), aimed at showing the general orientation of the Saudi regulator with regard to matters of proof through its statutory texts contained in the Saudi Evidence Law issued by Royal Decree No. (M/43) dated 26/5/1443 AH, and then this research was to study the general theory of proof with a statement of what the Saudi regulator has taken; to be this study as the rule that clarifies the general map of the provisions of this subject and its limits, as the introduction, the introduction and the prelude to the in-depth studies in its details and the provisions of the Saudi regulator. Each of the methods of proof contained therein, and the research came in an introduction, a preface, two sections and a conclusion, the preface was devoted to the statement of what is meant by the vocabulary of the title of the research, while the first section came to indicate the general provisions of proof, explaining the place of the provisions of proof in the regulations, the books of commentators and jurists, the legal and jurisprudential system of proof, and the persons of proof, while the second section came to talk about the general rules of proof, indicating the substantive rules as well as the formal rules. |
