| 520 | |a التعرف على تأثير انحراف السلطة كعيب يلحق القرار الإداري وعلاقته بظاهرة الفساد الإداري على التنمية البشرية في العراق، مع تسليط الضوء على أهم الوسائل القانونية لمكافحته، أذ يعد الفساد الإداري والمالي من الآفات الخطيرة التي تواجه جميع دول العالم دون استثناء الدول المتطورة منها أو النامية، وله تأثير سلبي على التنمية الشاملة والاستقرار السياسي والاجتماعي فالفساد يشوه البنية الاجتماعية وله تأثير على الدولة في مختلف أوجه نشاطها. فأن السلطة التي تتمتع بها الإدارة ليست غاية في ذاتها إنما وسيلة لتحقيق الهدف الأساسي وهو تقديم الخدمة لصالح المجتمع، فاذا انحرفت الإدارة في استعمال هذه السلطة بإصدار قرارات لتحقيق أهداف تتعارض ومصلحة المجتمع فان قرارها يكون مشوباً بعيب الانحراف في السلطة، ويوثر ذلك سلبا في ظاهرة الفساد الإداري والمالي التي تعيشها المجتمعات المعاصرة والعراق على وجه الخصوص، وقد توصلنا من خلال بحثنا إلى لظاهرة الانحراف باستعمال السلطة صورة متعددة سبق الإشارة إليها وان أخطر صورة من صور الانحراف بهدف تحقيق نفع مالي فتأثيره في ظاهرة الفساد يمتد إلى الجوانب الإدارية والمالية وهذه الصورة تعد محركا لكل حالات الفساد داخل المرفق العام، ونقترح أن يكون اختيار القيادات الإدارية والكادر الوظيفي على أساس الكفاءة وليس المحسوبية والانتماء السياسي والمذهبي لما له من تأثير في ظاهرة الانحراف بالسلطة لتحقيق مصالح أيديولوجية. |b The aim of the research is to identify the impact of the deviation of power as a defect inflicting the administrative decision and its relationship to the phenomenon of administrative corruption on human development in Iraq, highlighting the most important legal means to combat it, as administrative and financial corruption is considered one of the serious pests facing all countries of the world without excluding developed countries or It has a negative impact on comprehensive development and political and social stability. Corruption distorts the social structure and has an impact on the state in various aspects of its activity. The authority that the administration enjoys is not an end in itself, but rather a means to achieve the primary goal, which is to provide service for the benefit of the community. In the phenomenon of administrative and financial corruption experienced by contemporary societies and Iraq in particular, and we have reached through our research to the phenomenon of deviation by using the authority a multiple image previously mentioned, and the most dangerous form of deviation in order to achieve financial benefit, its impact on the phenomenon of corruption extends to the administrative and financial aspects and this image It is a driver of all cases of corruption within the public facility, and we suggest that the selection of administrative leaders and staff should be based on competence and not favoritism and political and sectarian affiliation because of its impact on the phenomenon of deviation in power to achieve ideological interests. | ||
