المستخلص:بيع التركة من العقود ذات الأحكام الخاصة، فهو يرتب التزامات على عاتق كل من طرفيه تختلف اختلافا جوهريا عن التزامات المتعاقدين في عقد البيع بوجه عام، فبالنسبة للبائع: بعض أحكام هذا العقد مستحدثة، كالتزامه برد مشتملات التركة للمشتري، والتزامه بضمان ثبوت الإرثض، أما بعضها الآخر وردت في عقد البيع بشكله التقليدي لكن طرأ عليها بعض التحوير، كالتزامه بالضمان والتزامه بنقل ملكية الحصة المبيعة. ويقابل ذلك التزامات خاصة على عاتق المشتري، لا يوجد لها شبيه في عقد البيع العادي، ومنها التزامه بسداد ديون الغير تجاه التركة، والتزامه برد ما كان البائع دائنا به للتركة، وهذان الالتزامان مستمدان من الطبيعة الخاصة لديون التركة واعتبارها ديونا عينية، فعدم كفاية النصوص القانونية على تنظيم هذا العقد ذو الطبيعة الخاصة، أوجب على الباحث تبيين الأحكام الخاصة لهذا العقد، ودفعه إلى إيجاد النتائج والتوصيات اللازمة لجعل هذا النوع من البيوع أكثر عدالة ووضوحا من قبل المقدمين عليه وتجاه للغير.

Selling the estate is one of the contracts with special provisions, It imposes obligations on the shoulders of each of its parties, These obligations are fundamentally different from the obligations of the contracting parties in the sales contract in general, For the seller: Some of the provisions of this contract are new, Such as his obligation to return the contents of the estate to the buyer, And his obligation to ensure the proof of the heir, As for the others, they were mentioned in the sale contract in its traditional form, but they have undergone some modification, Such as his obligation t to the guarantee and his obligation to transfer ownership of the sold share, This corresponds to special obligations on the shoulders of the buyer, Including his obligation to pay the debts of others towards the estate, And his obligation to return what the seller owed to the estate, These two obligations derive from the private nature of the estate's debts, and Considering it as a debt in kind, These legal texts are not sufficient to regulate this contract, which contains a special nature, made the researcher show the special provisions of this contract, And prompted him to find the necessary results and recommendations to make this type of contract more fair and clear in relation to those who perform it and towards others.
