| المستخلص: | يتناول البحث الكلام عن الاستحسان عند الكاساني ورأيه فيه من خلال كتاب بدائع الصنائع في ترتيب الشرائع ويركز على منهجه فيه، ثم يستعرض رأي الحنفية حول الاستحسان وسميته بعنوان الاستحسان عند الإمام الكاساني من خلال بدائع الصنائع، وكانت مشكلة البحث هي ما الاستحسان ورأي الكاساني فيه في كتابه بدائع الصنائع، وقد تطلبت طبيعة البحث الاعتماد على المنهج الوصفي، والمنهج الاستقرائي، والاستنباطي، مما سيجعل للبحث نتائج أهمها: استدلال الكاساني بالاستحسان على كثير من الفروع الفقهية الواردة في كتاب بدائع الصنائع في ترتيب الشرائع، وقد جعلت البحث مكونا من مقدمة ومبحثين هما: المبحث الأول هو ترجمة موجزة للتعريف بالكاساني، وأهمية كتاب بدائع الصنائع ومنهجه فيه والمبحث الثاني عن حجية الاستحسان عند الحنفية، ورأي الإمام الكاساني فيه ثم بعد ذلك الخاتمة وفيها النتائج والتوصيات. The research deals with the talk about the desirability of Kasani and his opinion about it through the book of prosaic works in the order of the canons and focuses on his approach to it, then reviews the opinion of the Hanafi about the desirability and its toxicity entitled: the desirability of Imam Kasani through prosaic works, and the problem of the research was what desirability and Kasani's opinion about it in his book prosaic works, and the nature of the research required relying on the descriptive, inductive, and deductive approach, which will make the research the most important results: many of the Fiqh branches contained in the book of the innovations of the crafts are in the order of the canons, and I have made the research a component of an introduction, and two researches are: The first section is a brief translation of the introduction to Al-kasaani, the importance of the book of the beginnings of crafts and its approach to it, and the second section is about the authority of approval at the Hanafi, and the opinion of Imam Al- kasaani in it, and then the conclusion, including the results and recommendations. |
