| 520 | |a يعتبر الحق في السلامة الجسدية من أقدس الحقوق التي يتمتع بها الإنسان، إذ هي لصيقة بشخصه، هذا الحق الذي اتفقت جل التشريعات السماوية والوضعية على العناية به وحمايته عبر جميع مراحل تكوينه، وإن اختلفت وسائل الحماية والضوابط الموضوعة لها. وقد تجلت صور الحماية القانونية في الجانب الطبي أثناء العلاج، والجانب الجنائي أثناء تجريم كل أشكال الاعتداء على السلامة الجسدية، أثناء الحياة وحتى بعد الوفاة باعتبار الجثة تتمتع بحرمة وجبت صيانتها من العبث والاستغلال ومن هنا تظهر الفوارق بين الشريعة والقانون في تجسيد هذه الحماية التي يعود نفعها على المجتمع. ولذلك تناول البحث مفهوم الخطأ الطبي من حيث الطبيعة القانونية للمسئولية و هل الطبيعة القانونية للمسئولية الطبية (مسئولية تعاقدية ام مسئولية تقصيرية) صور الحماية القانونية. |f The right to physical integrity is considered one of the most sacred rights that a human being possesses, as it is intimately connected with their personhood. This right is upheld and protected by both divine and man-made legislation throughout all stages of life, with varying means of protection and established controls. Legal protections are evident in the medical aspect during treatment, and in the criminal aspect through the criminalization of all forms of assault on bodily integrity, both during life and after death. The body is considered inviolable and must be safeguarded from tampering and exploitation. As a result, differences between Sharia law and secular legal systems become apparent in how they embody and enforce this protection for the benefit of society. Therefore, the research addresses the concept of medical error in terms of its legal nature of liability and whether this legal nature of medical liability (whether contractual or tort liability) provides adequate legal protection.
