| المستخلص: | تتفق دول المغرب العربي الجزائر وتونس والمغرب على أن عملية إعداد القوائم الانتخابية هي أول مرحلة في العملية الانتخابية، وتعد من الشروط الشكلية، حيث لابد أن يتوفر هذا الشرط الشكلي لكي يجوز ممارسة الحق الانتخابي لكل مواطن، لذا تمثل القوائم الانتخابية في كل هذه الدول الحجر الأساس في النظام الانتخابي برمته حيث تتوقف صحة وسلامة هذا الأخير على مدى مصداقية ودقة هذه القوائم، والتي من خلالها تتحدد الهيئة الناخبة المعبرة عن إرادة الأمة في اختيار رجال السلطة العامة. وأجمعت التشريعات الانتخابية لدول المغرب العربي، الجزائر والمغرب وتونس، ونظرا لأهمية هذه القوائم التي تبدأ بها العملية الانتخابية أكد القانون الانتخابي بإلزام السلطة المختصة في تنظيم عملية الانتخاب بالإشراف على إعداد قوائم الانتخاب بهدف حصر الأفراد الذين لهم حق ممارسة حق التصويت، واستبعاد المحرومين أو الذين لم يشملهم قانون الانتخاب. The Arab Maghreb countries (Alegria, Tunisie, Morocco) aggress that the process of preparing of preparing electoral lists is the first stage in the electoral process, and preach from the formal conditions, as this formal condition must be met in order to allow the exercise of the electoral right of every citizen, so the electoral lists in these countries represent the cornerstone of the entire electoral system where the health and safety of the latter depends on the credibility and accuracy of the these lists, through which the electoral body expressing the will of the nation is determined in the selection of public authority men. The electoral legislations of the Maghreb countries, Algeria, Tunisia, Morroco, unanimously agreed on the need to oblige the competent authority in organizing the election process to supervice the preparation of electoral lists, so that it is the first stage at which the electoral process begins.in order to limit the individuals who have the right to exercise the vote. And exclude the disadvantaged or those who are not covered by the electoral law. |
