| المستخلص: | تحاول هذه الدراسة الإجابة عن إشكالية: ماهي الأسس الدستورية لمبدأ المناصفة، على ضوء مضامين الوثيقة الدستورية لسنة 2011- وذلك من خلال الوقوف بداية عن مفهوم مبدأ المناصفة، والاختلاف الحاصل بين النص الدستوري بالنسخة العربية، والنص الدستوري بالنسخة الفرنسية، ثم تناولت الدراسة تصور الفاعل الحزبي لهذا المبدأ، على ضوء مقترحاتها التي قدمتها أمام لجنة تعديل الدستور لسنة 2011. This study aims to address the problematic question of what are the constitutional grounds for the principle of parity, in light of the contents of the 2011 constitutional document. To achieve this objective, the study starts by providing a clear definition of the principle of parity, and it then explores the differences between the Arabic and French versions of the constitutional document. Moreover, the study examines the perceptions of political parties towards this principle, based on the proposals they presented to the constitutional amendment committee in 2011. Furthermore, the study sheds light on the constitutional judiciary's perspective of the principle of parity by analyzing relevant decisions. |
