| المستخلص: | حيث ظهر لي من خلال هذا البحث عظيم نفع هذا القاعدة، ووجوب العمل بها، وأنها أصل من أصول التشريع يحتاج إليها العالم والمفتي والقاضي وولي أمر المسلمين، واشتمل البحث على مقدمة وفصلين وخاتمة. الفصل الأول (دراسة نظرية عن قاعدة فقه المآلات): وتشتمل على الآتي: المبحث الأول: التعريف بقاعدة اعتبار المآلات ونشأتها وأدلتها المبحث الثاني: أصل النظر في فقه المآلات، المبحث الثالث: مآلات الأفعال ومدلولاتها وفوائدها. وجاء الفصل الثاني (دراسة تطبيقية عن قاعدة فقه المآلات، بعض قضايا المرأة المسلمة المعاصرة نموذجا) ويشتمل على المسائل الآتية: المسألة الأولى تعاطى وسائل منع الحمل أو تأخيره، المسألة الثانية: استخدام الأدوية لمنع واستجلاب الحيض في شهر رمضان أو الحج، المسألة الثالثة: شق جوف المرأة لإخراج الجنين المسألة الرابعة: الفحص الطبي قبل الزواج، والمسألة الخامسة: الانتفاع بالجنين قبل نفخ الروح فيه المسألة السادسة: تحريم التلقيح الصناعي، المسألة السابعة: تحريم الزواج بنية الطلاق، المسألة الثامنة حكم زواج الزانية، المسألة التاسعة: حكم رتق غشاء البكارة لمن زنت ولم يشتهر زناها. المسألة العاشرة منع الزوجة من أن تؤجر نفسها في الرضاع والخدمة وغيره إلا بإذن زوجها. المسألة الحادية عشر: أثر عمل المرأة في الزمن المعاصر في النفقة والنشوز المسألة الثانية عشر: حكم خروج المرأة في الوقت المعاصر بغير إذن زوجها المسألة الثالث عشر: إسقاط الجنين إذا كان في بقائه خطر على الأم، المسألة الرابعة عشر: سفر المرأة بالطائرة بدون محرم. ثم الخاتمة والتوصيات والفهارس. As it became clear to me through this research the great benefit of this rule, and the necessity of working with it, and that it is one of the foundations of legislation, which the scholar, the mufti, the judge and the guardian of Muslims need, and the research included an introduction, two chapters and a conclusion: The first chapter (a fundamental study on the rule of jurisprudence of outcomes): It includes the following: The first topic: Definition of the rule of consideration of consequences and its origin, The second topic: Evidence of the rule of consideration of consequences, The third topic: The rooting of the jurisprudence of consequences, The fourth topic: The consequences of actions, their implications and benefits The fifth topic: Methods Uncovering the outcome. The second chapter (applied study on the rule of jurisprudence of outcomes, some contemporary Muslim women’s issues as a model): It includes the following issues: The first issue: the use of contraceptives or delaying it, such as the "IUD" and others, the second issue: the use of drugs to prevent menstruation in the month of Ramadan Or Hajj, the third issue: the incision of the woman’s stomach to remove the fetus, the fourth issue: the medical examination before marriage for the woman, and the fifth issue: the benefit of the fetus before the soul is breathed into it The sixth issue: Preventing women from driving a car The seventh issue: the prohibition of artificial insemination, the eighth issue: the prohibition of marriage with the intention of divorce, the ninth issue: the ruling on marrying an adulteress, the tenth issue: the ruling on repairing the hymen for those who committed fornication and whose fornication was not known. The eleventh issue: Preventing the wife from renting herself out for breastfeeding, service, etc, except with her husband’s permission. The twelfth issue: The impact of a woman’s work in contemporary times on alimony and disobedience The thirteenth issue: The ruling on a woman going out in the contemporary time without her husband’s permission The fourteenth issue: Aborting the fetus if its survival is dangerous for the mother The fifteenth issue: A woman traveling by plane without a mahram. Then the conclusion, recommendations and indexes. |
