| المستخلص: | أوكل المشرع المقارن، والعراقي بالقضاء الإداري مهمة الرقابة القضائية على أعمال الإدارة العامة، وهذه الرقابة لا يمكن أن تتحرك تلقائياً من قبل الجهة القضائية، وإنما لابد من قيام صاحب الشأن المتضرر في القرار الإداري بتحريكها؛ وذلك عن طريق اللجوء للقضاء بالوسيلة القانونية التي منحها القانون للأفراد ألا وهي الدعوى الإدارية والتي بموجبها يطلب صاحب الشأن أو المصلحة، إعمال رقابة القضاء الإداري على القرار الإداري المطعون فيه لبيان مدى مشروعيته وتمتاز الدعاوى الإدارية بطبيعة خاصة تميزها عن غيرها من الدعاوى، خاصة دعوى إلغاء القرار الإداري فهي دعوى عينية تستهدف حماية مبدأ المشروعية، والدفاع عن الحقوق والحريات العامة وحماية الأفراد والحد من توغل السلطة. The comparative and Iraqi legislator entrusted the administrative judiciary with the task of judicial oversight over the work of the public administration, and this oversight cannot be moved automatically by the judicial authority. This is done by resorting to the judiciary with the legal means that the law has granted to individuals, which is the administrative lawsuit, according to which the concerned party or interest requests the implementation of administrative judicial oversight over the contested administrative decision to show the extent of its legality. Administrative lawsuits are characterized by a special nature that distinguishes them from other lawsuits, especially the lawsuit to cancel the decision. Administrative, it is a real suit aimed at protecting the principle of legality, defending public rights and freedoms, protecting individuals, and limiting the abuse of power. |
