| المستخلص: | تعني هذه الدراسة بالبحث في اختلاف الأحكام ببعض التصرفات المالية بحسب الكلية والجزئية، وبما أن الأحكام موضوعة في الأصل بالجزء أي للشخص الواحد في الزمان الواحد فقد جعلت النظر إليها بحسب العموم في ذلك بمثابة العارض الذي يتغير به الحكم. واقتصرت هذه الدراسة على بعض تلك التصرفات التي تخص نقل الحق بعوض من مستحق إلى آخر في الأعيان: كالبيع والقرض، أو في المنافع: كالإجارة وفروعها، وبما أنها متنوعة بين العزائم والرخص فإن الاستشكال الذي حاولت الدراسة الإجابة عنه هو: هل هي على السواء في توجه الخطاب بها للواحد وللمجموعة؟ وتوصلت الدراسة إلى أن الأحكام فيها تختلف بحسب الكلية والجزئية بحسب قوة حق الله فيها بدخول أكثر من عارض يظهر ذلك. وكانت هيكلة البحث فيها- مع المقدمة والخاتمة- مطالب محتوية على دراسة ما يأتي: المباح والعوارض المؤثرة فيه، العزائم والرخص في التصرفات المالية بين الكلية والجزئية، حقوق الله في العزائم والرخص المرتبطة بالأعذار، التصرفات المالية المستثناة والحكم الاقتضائي، رأي الشاطبي في شمول القاعدة للتصرفات المالية المستثناة، سريان قاعدة اختلاف الأحكام بالكلية والجزئية على القرض، ما يترتب على اختلاف الأحكام في التصرفات المالية بحسب الكلية والجزئية. This study is concerned with examining the different rulings on some financial transactions according to the total and partial, and since the rulings were originally placed in the part, that is, one person at the same time, it made looking at them according to the generality in that as the accident by which the ruling is changed. This study was limited to some of those behaviors related to the transfer of the right in return from one owed one to another in properties: such as sale and loan, or in benefits: such as leasing and its branches. The study concluded that the rulings in it differ according to the total and partial, according to the strength of God’s right in it, with the entry of more than one symptom that shows that. The structure of the research in it- with the introduction and conclusion- demands containing the study of the following: Permissibility and the incidents affecting it, wills and licenses in financial transactions between college and partial, God’s rights in wills and licenses related to excuses, the exempted financial transactions and the judicial ruling, Al-Shatibi’s opinion on the rule’s inclusion of the exempted financial transactions, the application of the rule of different provisions in total and partial on the loan, the consequences of different Judgments in financial transactions according to the total and partial. |
