| المستخلص: | يهدف هذا البحث إلى الوقوف على حقيقة موت جذع المخ والآثار الفقهية المترتبة على خلاف الفقهاء والأطباء في الحكم بوفاة من مات جذع المخ عنده. منهج البحث: قد انتهجت في هذا البحث المنهج الاستقرائي التحليلي. وقد قسمت البحث إلى مقدمة، ومبحثين، وخاتمة. أما المقدمة فتشتمل على: أهمية الموضوع وسبب اختياره، وإشكالية البحث، والدراسات السابقة، ومنهجي وعملي في البحث. وأما المبحث الأول فيشتمل على ثلاثة مطالب: المطلب الأول: وقد جعلته في تعريف الموت في اللغة والاصطلاح. والمطلب الثاني: جعلته في ذكر علامات الموت عند الفقهاء. والمطلب الثالث: في ذكر علامات الموت عند الأطباء، أو نازلة موت الدماغ. وأما المبحث الثاني: في خلاف الفقهاء والأطباء في الحكم بوفاة من مات جذع المخ عنده. ثم ختمت البحث بأهم النتائج والتوصيات. The aim of the research: to stand on the truth about the death of the brainstem and the jurisprudential implications of the disagreement of jurists and doctors regarding the ruling on the death of someone whose brainstem has died. Research Methodology: In this research, I followed the inductive analytical approach. The research was divided into an introduction, two sections, and a conclusion. As for the introduction, it includes: the importance of the topic, the reason for its selection, the problem of the research, previous studies, and the methodology and practice of the research. As for the first topic, it includes three demands: The first requirement: I made it in the definition of death in language and terminology. And the second requirement: I made it mention the signs of death according to the jurists. And the third requirement: I made it mention the signs of death in doctors, or the coming down of brain death. As for the second topic: I made it in the disagreement of jurists and doctors in ruling the death of someone whose brain stem died. Then I concluded the research with the most important findings and recommendations. |
