| المستخلص: | إن العدالة الناجزة، والتعويض عن الأضرار، وعدم إفلات المجرمون الجدد من العقاب، تحتم بيان مفهوم الذكاء الاصطناعي، إذ تبين أن الذكاء الاصطناعي، هو مجموعة من البيانات والمعلومات التي تزود بها أجهزة الحاسوب، أو النائب الإلكتروني، لغرض القيام بعمل ما، حيث بين الباحث التطور التاريخي والتشريعي للذكاء الاصطناعي، ثم بينا مدى كفاية القواعد التشريعية في المسئولية المدنية والجنائية، لحكم العلاقات الناشئة عن استعمال أنظمة الذكاء الاصطناعي المتزايدة حيث تبين من خلال هذه الدراسة أن على المشرع- العراقي خاصة- أن يبادر إلى تطور المنظومة القانونية الحالية، وإصدار قانون ينظم عمل الذكاء الاصطناعي.
