المستخلص:An in-depth reading of the Moroccan family code reveals the extent to which this law is inspired by religion as well as the economic, cultural, and historical conditions it results from. It has witnessed substantial changes in the national and world arena, which has called for urgent amendments in the way the law is executed. Calls have also targeted the emergency to substitute the family code with one that could effect momentous changes in Moroccan society. In this context, although the family code was initially based upon the religious background, it guaranteed openness to other backgrounds. Also of key importance have been the role of customs in the continuity of the formation and organization of the Moroccan family, the jurisprudential fatwas following the Maliki doctrine, as well as the approval of the kingdom of Morocco and treaties related of the United Nations. The family code has relied on the four sunni schools of thought in addition to the Dhahiri doctrines despite the recent changes. It is worth noting that the Moroccan family code has been formulated in a simple modern style within the reach of the ordinary reader, far from jurisprudential complications.
