| المستخلص: | قد تتخذ الدولة عدة قرارات، مثل: قيام وزارة الزراعة بتخصيص نوع معين من المحاصيل؛ لزراعته في بعض المحافظات دون البعض الآخر، أو من قبل بعض المزارعين دون البعض الآخر، بهدف ضمان التوزيع الجغرافي لبعض المحاصيل المعينة، والتي يناسبها تربة معينة، أو أجواء معينة، أو كمية المياه الجوفية المستهلكة، فيقوم بعض المزارعين بعدم الالتزام بهذه القرارات؛ لتحقيق مصالح شخصية دون النظر إلى الضرر المترتب على هذه المخالفة على العامة، وهذا من الناحية الفقهية يعتبر نقصا للشروط والعقود ويعتبر مرتكبها أثما شرعا لمخالفته قرارات ولي الأمر، وقد اعتبر القانون الوضعي المصري ذلك جريمة، ورتب عليه عقوبات الحبس والغرامة المالية، بالإضافة إلى إزالة المخالفة على نفقة المخالف. The state may take several decisions, such as when the Ministry of Agriculture allocates a certain type of crop to be planted in some governorates without others, or by some farmers without others, with the aim of ensuring the geographical distribution of some particular crops, which are suitable for a certain soil, atmosphere, or the amount of groundwater consumed, so that some farmers do not comply with these decisions; to achieve personal interests without regard to the harm caused by this violation to the public. From a jurisprudential point of view, this is considered a violation of the terms and contracts, and the perpetrator is considered a legal sin for violating the decisions of the guardian. As such, the Egyptian man-made law considered this act as sort a crime that entails the penalties of imprisonment and a financial fine, in addition to removing the violation at the expense of the violator. |
