| المستخلص: | تناولت الدراسة وسائل تحقيق المناط وهي إحدى أدواته التي تمكن المجتهد من إثبات وجود العلة في الفروع والجزئيات، من خلال بيان المقصود من تحقيق المناط والغاية من إدراك وسائله، وكيف يساهم ذلك في ضبط عملية التنزيل الصحيح للأحكام الشرعية على وقائعها العملية المناسبة، وبينت أن هذا لا يتم بطريقة آلية، بل لابد أن يستند إلى تلك الوسائل الكثيرة والمتنوعة والمتجددة حسب الزمان والمكان، إظهارا لثراء الشريعة الإسلامية ومرونتها، وقدرتها على الوفاء بحاجات الناس ومصالحهم، مستمدة ذلك من المنهج العلمي الرصين الذي سلكه القاضي عياض في مناقشة الاختلاف الحاصل بين علماء المالكية في هذا المجال. This study deals with the means of identifying the motive (of religious judgements); which is a tool that allows the preserving scholars to confirm the presence of the cause of the judgement in minor people’s issues. This is reached through stating the meaning of “Motive Identification” and the aim of grasping its means, and how it contributes to governing the right application of religious judgements on the right practical events. I also showed that this does not happen in a mechanical way, but it rather relies on various different and renewed means depending on time and place. This exposes the richness and flexibility of Islamic law, and how it is capable of covering people’s needs and benefits, thanks to the the firm method followed by Al QuadiIyad in discussing the differences between Maliki scholars in the domain. |
