| المستخلص: | يتناول البحث أحد الأمراض النفسية، وهو مرض الانفصام وأثره على عقد النكاح؛ وقد جاء البحث في مقدمة، وثلاثة مباحث، وخاتمة. أما المقدمة: فقد تناولت مشكلة البحث، وأهميته، ومنهج البحث، وتساؤلات الدراسة، وأدواتها. وجاء المبحث الأول في: مفهوم مرض الانفصام، وعقد النكاح. والمبحث الثاني: العيوب الواردة على عقد النكاح وضابطها. والمبحث الثالث: أثر مرض الانفصام على عقد النكاح. وأما الخاتمة: فقد اشتملت على أهم النتائج ومنها: أن الانفصام هو من الأمراض النفسية، التي تجعل المريض وكأن ذاته وأحاسيسه، وإدراكاته، منقسمة، وهو مرض حديث، ولكن أعراضه تشبه مرض الجنون، بجامع مكان الإصابة فيهما، والآثار المترتبة عليه، فهو يصيب العقل باضطراب، وعدم القدرة على التفكير السليم، كما يؤثر في سلوك المريض، فيجعله غير طبيعي، ومرتبكا دائما. ويوصي البحث بإلزام المقدمين على الزواج، بإجراء الفحص الطبي، قبل العقد، حتى يتبين كل منهما حل الآخر، ولا يقع في غبن، أو غش، أو تدليس؛ وأن ترفق نتيجة الفحص بالأوراق المعدة لعقد القران، بصورة رسمية، حتى يطلع عليها المأذون، ويثبت خلو الطرفين من العيوب المعتبرة؛ والبحث أكثر من قبل الدارسين في كتب التراث لاستخراج ما فيها من أحكام، تنطبق على حياتنا المعاصرة، فهم لم يتركوا شيئا إلا وقد نصوا عليه، وتحدثوا فيه، وكأنهم يعيشون بين أظهرنا، وضرورة البحث أكثر من قبل الأطباء الحاذقين، لإيجاد دواء لهذا المرض الخطير، فما خلق الله من داء إلا وخلق له دواء علمه من علمه وجهله من جهله، حتى تنتهي معاناة ا لكثير من المرضى، وتستقر الحياة. This research deals with one of the psychological diseases, schizophrenia, and its impact on the marriage contract. The research came in an introduction, three chapters, and a conclusion. As for the introduction: it dealt with the research problem, its importance, the research method, the study questions, and its tools. The first topic: the concept of schizophrenia and the marriage contract, the second topic: the defects contained in the marriage contract and its controller, and the third topic: the impact of schizophrenia on the marriage contract. As for the conclusion: it included the most important results, including: that schizophrenia is one of the psychological diseases that make the patient as if himself, his feelings, and his perceptions are divided, and it is a modern disease, but its symptoms are similar to madness, in terms of the place of injury in them, and the effects of it, it affects the mind with disorder, lack of The ability to think properly, and it affects the patient's behavior, making him abnormal and always confused. The research recommends obligating those who are married to conduct a medical examination, before the contract, so that each of them becomes clear about the other's condition, and does not fall into unfairness, fraud, or fraud, and that the results of the examination should be attached to the papers prepared for the marriage contract, in an official manner, until the authorized person sees them, and proves that there is no The two sides of the considered defects, and more research by scholars in heritage books to extract what they contain of provisions, applicable to our contemporary life, they did not leave anything except that they had stipulated it, and spoke about it, as if they were living among us, and the need to search more by skilled doctors, to find A medicine for this dangerous disease, for God did not create a disease without creating a medicine for it that he taught from his knowledge and ignorance from his ignorance, until the suffering of many patients ends, and life is stabilized. |
