| المستخلص: | المذهب الحنفي شأنه شأن باقي المذاهب الأخرى كان سبَّاقا في تحليل أقوال أئمة المذهب المجتهدين وعلى رأسهم الإمام أبي حنيفة وأصحابه، وبيان صحيحها من ضعيفها، وراجحها من مرجوحها، فقول ظاهر المذهب هو المعول عليه في الفتوى، وهو يمثل قول إمام المذهب أبي حنيفة رحمه الله، فهو المقدم على غيره في الإفتاء. أما قول أصحابه وتلامذته فمرجعها إليه فالثابت عند الحنفية أن أقوال أصحاب الإمام أبي حنيفة هي أقوال الإمام نفسه، فهو يعرض احتمالات عدة على طلابه ويناقشها، فيختار منها ما يؤديه إليه اجتهاده أنه أقرب إلى الصواب، وأصحابه تارة يوافقونه، وتارة أخرى يخالفونه بحسب اجتهادهم، دون أن يخرجوا عن أصول المذهب وقواعده التي قررها شيخهم. وكل ما يخالف ظاهر المذهب أو الأصول والقواعد يسمى بالغريب. فكان البحث في بيان معنى الغريب، وأسباب الغرابة، ونماذج من الفروع الفقهية في مذهب السادة الحنفية لبيان ذلك. The Hanafischool, like the rest of the other schools of thought, was a pioneer in analyzing the sayings of the hard-working imams of the doctrine, led by Imam Abu Hanifa, Imam Abi Yusuf and Imam Muhammad bin Al-Hasan Al- Shaybani, and clarifying its authenticity from its weak, and the most correct of it from its preponderant. The imam of the madhhab, Abu Hanifa, may God have mercy on him, is ahead of others in issuing fatwas. As for the sayings of his companions and students, it is referred to him. It is established by the Hanafischool that the sayings of the companions of Imam Abu Hanifa are the sayings of the imam himself. That they deviate from the principles and rules of the madhhab established by their sheikh. Thus, those who came after them devoted themselves to studying these sayings, distinguishing between what is apparent and what is not, and the fatwas with it and others, and everything that came against the rules of the madhhab or the sayings of its imams, they described it as strange. The research was to explain what is strange, what are the causes of strangeness, and models from the branches of jurisprudence in the Hanafi school of thought to explain that. |
