| المستخلص: | وردت أحاديث وأخبار عديدة نهت عن معاملات مالية كثيرة، وظاهر هذا النهى قد يستنتج منه البعض ويتوهم أن كل تلك المعاملات المالية المنهى عنها شرعا كيفما كان نوعها وموضوعها فاسدة، استنادا منه إلى تلك الأحاديث، وإلى القاعدة الكلية: "النهي يقتضي الفساد"، وكون ذلك النهى والفساد متلازمين، وإذا فسدت اقتضى ذلك نقضها وحلها لا إنفاذها وإمضاؤها ولا ريب. وهذا الاستنتاج والفهم خطأ بين وليس بشيء، إذ هناك عقود ومسائل من التصرفات المالية وإن ورد النهى عنها قد صحت ومضت عند المالكية لدليل شرعي آخر اقتضى الصحة ونفي الفساد فيها عندهم. أتى في متن مختصر الشيخ خليل رحمه المولى تعالى ما نصه: "وفسد منهي عنه إلا لدليل" اهـــ 1 There have been many sayings by the prophet MUHHAMED Peace be upon him that prohibits various monetary transactions, and some conclude from this and have the delusion that all those prohibited transactions no matter what their kind or content is corrupt, based on the prophet sayings, and the general rule: "prohibition implies corruption", and that the prohibition and corruption are inseparable, but if it's corrupted it a necessity for it to be terminated not enforcement it without the shadow of a doubt. This conclusion and understanding are a manifest error and hold no grounds because there are contracts and matters in financial transactions that even if they are prohibited they're correct and validated in the MALIKISM (a school of Islamic law) for another forensic evidence that makes them correct and denies their corruption. In book MUKHTASSAR the sheikh KHALIL God rest his soul, it says: "what is prohibited is corrupt only for evidence". 1 |
