| المستخلص: | تعتبر الأخطار النفسية والاجتماعية بمثابة قضية أساسية ومحورية في عالم الشغل، ومن بين التحديات والرهانات الكبرى التي تواجه الدول والمجتمعات. والجزائر كغيرها من الدول لم تكن بمنأى عن هذه المخاطر المستجدة التي أصبحت تهدد وتستهدف الإجراء داخل أماكن العمل. وبالرغم من ارتفاع منسوب هذه الفئة من الأخطار المهنية، إلا أن المنظومة التشريعية في الجزائر لم تتطرق لهذه الأخطار، الأمر الذي صاحبه فراغ قانوني كان ضحيته طبقة الإجراء الذين يعانون في صمت. وفي ظل غياب نظام قانون خاص يستوعب هذه الأخطار المستجدة، جاءت هذه دراسة بهدف تسليط الضوء على الآليات والسبل التشريعية المتاحة والراهنة بشأن حماية الإجراء ووقايتهم من الأخطار النفسية والاجتماعية. Psychosocial risks are a fundamental and central issue in the world of work, and among the major challenges and bets facing states and societies. Algeria, like other countries, has not been immune to these emerging risks, which have become threatening and targeting employees in the workplace. Despite the high level of this category of occupational risks, the Algerian legislative system has not responded to these threats, which have been accompanied by a legal vacuum that has been the victim of the working class, which suffers in silence. In the absence of a special legal system to deal with these emerging threats, this study aimed to highlight the legislative mechanisms and the means available and current to protect employees and protect them from psychosocial risks. Les risques psychosociaux sont une question fondamentale et centrale dans le monde du travail, et parmi les défis et les paris majeurs auxquels sont confrontés les États et les sociétés. L’Algérie comme d’autres pays, n’a pas été à l’abri de ces risques émergents, qui sont devenus menaçants et ciblant les salariés sur le lieu de travail. Malgré le niveau élevé de cette catégorie de risques professionnels, le système législatif algérien n’a pas répondu à ces menaces, qui se sont accompagnées d’un vide juridique qui a été la victime de la classe ouvrière, qui souffre en silence. En l’absence d’un système juridique spécial pour faire face à ces menaces émergentes, cette étude visait à mettre en évidence les mécanismes législatifs et les moyens disponibles et actuels pour protéger les salariés et les protéger des risques psychosociaux. |
