| 520 | |a تعتبر المنازعات الدولية بصفة عامة والمنازعات البحرية بصفة خاصة من أخطر المنازعات وأكثرها انتشارا في الآونة الأخيرة، واستمرار مثل هذه المنازعات لا يؤثر فقط على العلاقات بين الدول المتجاورة، بل يمكن أن يتحول إلى مواجهة عسكرية تؤدي حتما إلى تهديد السلم والأمن الدوليين، ومع تصاعد وتيرة هذه المنازعات وما تلحقه من أضرار بات أمر تسويتها بطرق سلمية أمرا ضروريا، وهذا ما نصت عليه المادة 33 من ميثاق الأمم المتحدة. وتسوية هذه المنازعات بالطرق السلمية هو غاية المجتمع الدولي ككل، بهدف منع استخدام القوة وإرساء مبادئ السلم والعدالة، ولأجل ذلك كان لابد من وجود هيئات قضائية دولية تكون لها ولاية النظر في مثل هذه المنازعات ومن أبرز هذه الوسائل القضائية محكمة العدل الدولية والمحكمة الدولية لقانون البحار اللتان ساهمتا وبشكل كبير في تطوير القانون الدولي للبحار من خلال حل العديد من المنازعات والقضايا البحرية. |b International disputes in general and maritime disputes in particular are among the most dangerous and widespread disputes in recent times, and the continuation of such disputes not only affects relations between neighboring countries, but can also turn into a military confrontation that inevitably leads to a threat to international peace and security, and with the escalation of The frequency of these disputes and the damages they cause have become necessary to settle them by peaceful means, and this is what was stipulated in Article 33 of the Charter of the United Nations. The settlement of these disputes by peaceful means is the aim of the international community as a whole, with the aim of preventing the use of force and establishing the principles of peace and justice. They contributed significantly to the development of international law of the sea by resolving many disputes and maritime issues. |d Les conflits internationaux en général et les conflits maritimes en particulier comptent parmi les conflits les plus dangereux et les plus répandus de ces derniers temps, la poursuite de ces conflits n'affecte pas seulement les pays voisins, mais peut se transformer en un affrontement militaire qui menace inévitablement la paix et la sécurité internationales, avec l'escalade de ces différends et les dégâts qu'ils causent, il est devenu nécessaire de les régler par des moyens pacifiques, comme le stipule l'article 33 de la Charte des Nations Unies. Le règlement de ces différends par des moyens pacifiques est l'objectif de la communauté internationale dans son ensemble, dans le but d'empêcher l'usage de la force et d'établir les principes de paix et de justice, pour cette raison, il était nécessaire d'avoir des organes judiciaires internationaux qui auraient compétence pour examiner de tels différends, les plus importants de ces moyens judiciaires liés aux méthodes judiciaires sont la Cour internationale de Justice et le Tribunal international du droit de la mer, ils ont grandement contribué au développement du droit international de la mer en résolvant de nombreux différends et problèmes maritimes | ||
